‘ gen, about 30 feet from the track of this defendant; that a
short time thereafter, one of defendant's trains was approach.

said mules, and endeavored to keey them quiet, and did no hold
said mules until the engine gut almost opposite them, when the
said mules became uncontrollible and broke away from said pl-
aintiff, Hianer, and turned and started running down the side
track of this defendant, and attempted to cross said track
