Mr. Morgan's letter to you of March 18th which you
sent to me with your favor of March 20th relative to claim of
Sam Grigsby on account of our alleged conversadon or appropria-
tion of 196 013711 ties at the mouth of Second Creek, Perry County,
in September,1915, is herewith returned. I am also handing
you herewith Supt. of Construction Smith‘s letter to me of
Mardh let, together with papers referred to therein.
Under the circumstances there is nothing for us to
do but to decline Mr. Grigsby's claim.

me of March 20th together witb1coPy of letter dated March 18th from
Mr. Jesse gorgen oreeenting claim on behalf of one Sam Grigsby
who lives on Second Creek, in ‘erry County, and who claims that
196 cull ties which he had stored on the railway comyany's right
of way at Second Creek, were taken up in fieptember,l913 by an
extra gang in the Service of the L. a B.

The plaintiff, Sam Grigsby, states that the >
Defendant, Lexington & Eastern Railwaf Company, is a
corporation organized and existing under the laws of the
State of Kentucky and as such has a right to contract, and
be contracted with, and to sue and be sued in its airporate
name aforesaid, and that some time during the year of 1913
or 1914, the defendant by its agents and employee acting
under it, took from the possession of this plaintiff, 196
railroad ties, worth the sum of $98.00, and converted
same to its own use Without the consent and against the will '
of this plaintiff, all of which took place in ferry County,

‘ Kentucky.

WHEREFORE, plaintiff prays judgment aga.nst the
defendant, Lexington & Eastern Railway Company,e£or the sunl
of $98.00 with interest thereon from the 25th day of Lay 1914,
until paid and he prays for his cost herein expended. ,

consequence in , that he could not tell anythiwc about it the road
that lead into thin plat of wround heflore the oorvtruction ot the rail- ,
road ; and nowhere in hie testimony ioee he chow that there wee
any road left-above hich—water mark, of that part of the tract of
lend that wee rituated below the rinht of may of Appellant'g road.
