Dear Sir:—

Relative to the deed from W. M. Hall the record of which
at Whitesburg shows that he is to receive $1,000.00 per acre for the
additional land, will say that I have a letter from MI. Fields ad~
vising that he duly received this deed when I sent it to him some-
time ago for the purpose of making the correction, but that the
clerk was unwilling to make the correction since the deed had gone
out of his possession — and he is right about this - so Mr. Fields
is keeping the deed in the fire proof safe at Whitesburg as the
evidence of the real transaction when the question arises. '9

I have written him again to now see Hall or Hall's attorney
and show him the original deed, which I recall shows plainly upon

[5' "Harfield. You will remember that I called your attention
to the ’.7.M.Hall deed in that it specified 331000.00 pfrr acre
for additional right of way, and on your request of March 25th
the deed was returned to you with ax} letter of April 4th for
coorection, as you stated the agreement was at the rate of
$100.00 per acre for the additional right of way. You will
note from the attached letter that claim is made that the
agreement was that additional right of way was to be paid for
at the rate of $1000.00 per acre. Will you please advise
me if you were able to straighten this matter out and if
we can stand on our original deed which was corrected to
read ($3100.00 per acre. If so, I Will advised our Resident
Engineer that the original deed calls for $100.00 per acre,
and that if this rate is not acceptable to L:r.Hall, it
will be necessary for him to bring: suit to recover the
difference.

Lexington & Eastern Railway 60., etc., Defendants.
By agreerent of the parties it is adjudged by the court
as follows:
(1) That the deed of Novenber 7th, 1910, tron the plain—
tiff, W. M. Hall and wife, Sarah Hall, to the defendant, Lexington
& Eastern Railyay Co., conveying to said defendant a strip of land
through plaintiff's farm for its right of way for railroad purposes,
a copy of Which was filed with the petition herein, Parked "A",
fixed the price of such additional widths or strips which night
thereafter be taken and used by said defendant as provided for in
said deed at the price of one thousand dollars per acre taken, and
that the words fiéCOC per acre," as written upon the record by the
defendant, R. B. Bentley, Clerk of the County Court of Letcher Coun-
ty, in recording said deed is a true and correct copy of that part
of said deed fixing the price of such additional widths or strips.
(k2) That the strip of land described in the petition as
having been taken and need wvy the defendant, Lexington & Eastern
Railway Co., in the construction of its line of railroad,— and
" hereinafter described,e was not taken or used under that provision
in said deed authorizing said defendant to take are use additional
widths or strips of land upon the paynent therefor of the parice per
acre aforesaid, and therefore said defendant has acquired no title
to, or ownership of, said tract of land. '
(5)_ That the defendant, Lexington & Eastern Railway Co.,
in the construction of its line of railroad has danaged said tract
' of land to the enount of two hundred and forty—five dollars ($245.00)

and that the plaintiff W. M. Hall, therefore recover of said defenr
dent the sum of two hundred and forty—five dollars ($245;G0) end
his costs in this behalf expendefig>

(4) That the cross—petition of the defendant, Lexington
& Eastern Railway Co. against the defenfiente, B. B. Bentley, County
Court Clerk, and Sarah Hell, be, and the sane is dienieeed, and that
said defendants reCOVer of the defendant, Lexington & Eastern Ry.
00., their costs herein expended.

Said tract of lanfl is described as follows: Situated in
Letoher County, Kentucky, at the lower end of plaintiff's fern,
embracing that part on said fern lying between the strip of land
conveyed to the defendant, Lexington & Eastern Railway Co. by the
