through collusion with a juror, coupled with bribery, is not only
sufficient but makes it the duty of the Court to set aside the
verdict and grant a new trial. If such practices are nermitted,
there can be no justice and obtaining verdicts would descend to
the level of barter in the market-place.

The affidavit of the juryr, G. F. Zion, discloses the feet
that both the juror in question, Sherman Rapier, and his father,
Samuel Napier, stood out for a verdict of $5,000.00, and that after
the jury reported to the Court that a verdict could not be reached
and the Court directed the jury to 50 back to the jury room, the
juror, Chermon Hepier, after their return to the jury room stated
that he would agree to a verdict of $5285.00, but that he would not
agree to a smaller verdict, and that, if the jury did not agree to
that in a short time, he would not agree to so small a verdict.
Acting under this lash, a sufficient number agreed to this verdict, I
but lamucl Napier, the father, stood out for $5,000.00 and refused
to sign the verdict. This shows that acting in conformity with
his agreement with appellcc, the juror, i5h(—3rman denier, took the ‘
lead for a high verdict and fought the amount as high as he could
all through the deliberations of the jury and, by his insistence,
caused the verdict to be reached for on amount that is palpably
excessive.

" 'Lost time' as an element of damage means time that is
totally lost, due to the fact that the injured party cannot
follow any wage—earning occupation, as when he is confined to
his bed by the injuries. It is more than the impairment of the
power to earn money, as 'impsirment' implies that the injured
person can perform some service or follow some w ge—eerning
occupation, and that his ability to earn money, although reduced,
is not totally destroyed. Of course an injury not resulting
in death night totally destroy the shi ity to earn money, but this
rarely happens. It follows, therefore, that if jronerly pleaded
and supported by evidence there may be a recovery for lost time
without reference to whether the injury is permanent or temporary.
It is usually 3 claim made in addition to the amount that is asked
for the impairment of the power to earn money, and as a rule ore—
cedes the claim for impeirmont, because total disability generally

follows immediately upon the injury, while impairment of the now—

er to earn money,begins when the injured person is able in some
degree to follow a wage—earning occupation. There oumht not, of
course, to he an allowance for lost time and for impairment of
the power to earn money during the some period, as this would
allow the injured party to recover double damages. Her is it
necessary thet the infiuirment of the power to earn money should
he uermnnent to enable an injured uerson to ohtein conuensation
for impairment of the power to earn money. He is as much entitled
to recovery for the tentornry inpuirment of the power to earn
money as he is for the permanent imfeirment of the power to earn
money. For instance, a gorse“ may sustain injuries thet will
totally disable him from employment for say six months, and that
will pnrtially disable him from following en 0 cupetion,for, soy,
six months longer, end, if so, he is entitled to recover for the
time lost as well as for the impairment of the power to earn money
from the time he is able to earn some and until a connlcte cure
has been effected. Of course, when the injury is permanent, and
there is n permanent impuirment of the power to enrn money,
however slight it may be, there may also be a recovery for time
lost by reason of the injury, and in addition thereto for per-
manent in nirment of the newer to earn money. But when there is
a claim for special damages based on time lost, and also a claim
for partial or permanent injuries, end as a consequence impair—
ment of the ;ower to earn money for any length of time or forever,
as the case may be, the allowance for the imueirment of the
newer to earn money, Whether it be tempornry or permanent, should
begin when the allowance for lost time on account of total dise-
hility ends. This measure will give to the injured party onpor—
tunity to recover full connensntion on account of loss due to
inability to labor in whole or in wort, and is all he is entitled
to on this account, unless it is sought to recover exemplary dam—

"This rule as to beginning the allowance for the imneirment
of the power to earn money at the time that the allowance for
loss of time nude, in order to prevent the assessment of double
damages, when there is a claim for lost time as well as impair-
ment, has been frequently recognized as correct by this court
in different forms of expression, although the matter may not have
been nut in the language here employed. This is illustr:ted in the
opinion in the case of L. & H. R. Co. v. Barrickmen, 104 S.V. 275,
31 Ky. Lew hep. 885. There the jury was instructed that they
