Some few days ago Mr. Ira Duff of Chavies, Kym, was plowing near our right
of was and his horses became frightened and ran off and one of the horses broke his
leg. hr. Dug-g was about 90 feet from our right of way and or. the ins inc 0’? his fieli
but he claims that our train whistled and freightenezi his horses and made then run off
and he further makes the statement that after the engineer SE?! his horses were scared

Conclr. john Greer and he corroborates all that Enginner Tandy says about this.

Th‘s horse, in my Opinion, was not worth over $15,510 but Mr. Duff ‘.'-rants
me to pay him $500.00. It would seem to me that we wonlti not owe Mr. Duff any lookout
duty in view of the fact that he was considerable distance from our right of way and
certainly would not owe him any rm duty until after we discovered his peril.
Please favor me with your opinion as to what you think best for me to do.

for less etc, so.I.finally.told.him.that I.nao already offered Adams
.to much money, and unless.he could Show me other damage, that I was not

My Dear Sir:-

I saw Mr.Adams yesterday and discussed the V
proposition of a settlement of your matter, and I advised him
that he could not, in my judgment, at the end of a suit recover
more than $300.00, and told him that it was the best thing he
could do to settle the matter at this figure. I tried to get

‘ him to accept $275.00, but he would not agree to do it.
On investigation I found that there is but very little dispute
over the facts, except the number of acres of pasture lands
the fire burned over, and while he claims that there were
sixty five acres burned over, I am of the opinion that it
is not over half of that number of acres. I made a hard pull
with Mr.Adams to get him to $300.00. Mr. Adams' neighbors
down there and men that we were discussing at Lexington are
urging him to have the suit brought, but if youn are willing
to settle on the basis of $300.00, fix up the papers and send
me and I will sign them up and have Mr.Adams to sign them
up also.

Dear Judge:-

During my absence on my vacation, A.H.Hargis filed suit
in Squire Watkins court and took judgment by default for $10.47
value of 100 pounds of Whitelead claimed to have been lost in transit.

I have investigated as best I can and am informed by plaimr
tiff that Peasly, Gaulbert and Company of Louisville shipped this
lead to him from Louisville about March 1916. He says he filed a
claim with the agent here and repeatedly demanded settlement, and
getting no satisfation filed the suit and took judgment.

I inclose copy of statement filed by plaintiff, and upon
which summons was issued. The judgment was rendered on August 7th,
gig have sixty days from that date in which to appeal if we have any
defense. Please have this matter investigated with as much diSpatch
as possible, and if the company is liable, have voucher forwarded
so that I can settle. If we are not liable, kindly advise me before
Oct 5th, so that I can appeal the case before it is too late.

While I know nothing except what I learn from the Plaintiff
' I am inclined to the opinion that investigation will show that the
company is liable and with that idea, I alson inclose form 4 bill of
judgment and costs.
