Yours Aug. 10:
Touching your suggestion as to the use of the word
"dingey" in connection with the engine of Armstrong &
Bragg: Webster's New International Dictionary, 1916,
does not give the word "dinkey" or "dinky" at all. It
gives the words "dinghy," "dingey," and "dingy," with
three definitions. The first and second refer to a
boat, as you say, but the third definition is:"Railroads:
A car fitted with sleeping accommodations, &o., for use
of men working along the track." But all of these
definitions convey the meaning of something small. And,
hence, the corrupted term of "dingoy" as applied to
a small engine such as the Armstrong & Bragg Co. engine
was. So that, my conclusion is that the word "dingey"
as I have used it in the brief is correct, and that
there is no such word as "dinkey" or "dinky," which
are merely corruptions.

Since receiving your letter I have redrafted and
somewhat amplified my discussion of Instruction No. 2,
in an effort to carry out the thought suggested by
you as to the vagueness of the instruction. I am
I sending you herewith carbon copies of the redrafted
pages of the brief, which, after you read them, you
I can forward to Judge Pollard and ask him to read them
and then deliver them to opposing counsel to be
substituted for page 5 of Points Discussed and
Authorities Cited; and pages 55 and 56 toward the
end of the brief we have already furnished.
I think the question of whether or not White
and the engineer were in the same department of service
or in separate departments is close, and it may be the
court will take your View of that question. I have
supplemented the argument as to the error in the '
instruction as to the measure of damages by the .
suggestion of its error in not limiting the damages
to permanent impairment of power to labor to begin
I after the allowance for lost time ceased, but I do
not think the court will pay any attention to this
argument, for the reason that we did not ask to have
the instruction modified or offer an instruction on
. this point ourselves, so far as the record shows, and
I presume the error is waived.

do not believe that a printed brief does any more good
than a typewritten brief, and there is nothing
particularly impressive about the brief such as would.

Dear Sir,

Yours June 9, covering carbon CGpiss of drafts of
proposed stipulation and order to beexeouted by counsel
on both sides, and to be entered by direction of the special
judge to be designated in the stipulation, respectively,
received.

It seems to me these documents are in proper form, and
that if you can reach an agreement with Opposing counsel as to
who the special judge shall be, insert his name in the blank
left in the stipulation for that purpose and have it executed
by Opposing counsel, as well as by Judge Pollard and you for
Judge Wilson, as counsel for the defendants, and have the
stipulation filed as a part of the record in the case, and
then have the special judge approve the bill of exceptions

' and attest the transcript of evidence, and make the order
as shown by the draft sent me, our purpose will be accomplished.
In other words, I have concluded, on authority of SV&d Ry.Co.
v. Bentley, 175 Ky. 756, and Combs v. Combs, 175 Ky. 523,

that it is entirely permissible for the parties to the
litigation to agree to the signing of the bill of exceptions
and approval of the evidence by a judge other than the one
who tried the case, and that where a party has thus agreed
he will not be heard to raise any question as to the transcript
of evidence and bill of exceptions being properly a part of
the record on appeal.

I doubt if it is worth While to make any effort to get
Judge Bailey to come to Jackson to approve the bill, unless
you fail to get opposing counsel to agree to execute the
stipulation as proposed, in which event the matter can be
closed up the first day of the next term of the Breathitt
Circuit Court, so that the
