Dear Sir:
Allow me to renew my congratulations as to the result of
. the indictment at Beattyville. It was an exceedingly important oasemv
and evidently was well handled by~you and h;} Hurst. Judge Riddell
was here Saturday night and I had a full talk with him about this
‘ matter. He said he would have been justified in giving a peremptory
instruction, but thought that the defendant would win and would be
in a very much better position if the jury should give a verdict in
its favor. I told him that his logic was sound, but the risk very
great, though, as it turned out favorably, I doubted not that his
course was better for us. I talked to him about the other cases and
I think it is his idea that nothing will be done in them at this term.
I am writing you particularly with reference to your letter
to Mr. Hurst of February 5th, copy of which you sent me. I note that
at the close of that letter you suggest that it would perhaps be advi—
sable to waste no time in preliminaries, but bring the case up on
demurrer. We here have concluded that it might be better to have all
the delay possible in this case for two reasons. First, because the
Court of Appeals will be more inclined to decide for us in a criminal
case than in a civil case, and particularly when the local sentiment
is with us, as evidenced by the verdict of a jury. We will, therefore,

in all probability get a favorable declaration from the Court of
Appeals as to the law in this case, and would then have it on tap for
use in the civil action. Second, the longer we use the new route
the more accustomed and satisfied will the people become with the
change, the more remote and indefinite will become the damage incident
to abandoning the old line, and the more reluctant will any court be
to upset the established order of things a this latter relating
especially to the possibility of a suit by the state to restore the
old line. Under these circumstances I think it would be well for
you to avoid any hearing upon the demurrer at least at this term,
even if you are forced to the point of filing a demurrer.

I think that you can make a very plausible appeal to Judge
Riddell to await the decision of the Court of Appeals on some
kindred questions in your 00mmonwealth's case. If you become badly
crowded for reasons you might suggest that I would like to be heard
in the argument and I am really so tied up for some days that I could
not get away to do it, much less make the necessary preparation in the
library. It is an appearance case and one that could not possibly
be reached for trial, so that I think it is entirely within reason
for the court to pass the hearing on the demurrer. Lest something
may be done at once, in view of your letter, I am taking the liberty
of telegraphing Mr. Hurst not to file demurrer until he gets this
letter.
