He states that in returning from his work as aforesaid on said
day on said hand car the agents, servants and employee superion
V in authority over the plaintiff, propelled a hand car provided
by the defendant for the use of the men in going to and from
work, and upon which this plaintiff was then riding at such a
high rate of speed that the plaintiff host his hold.m.the han-
dle bars, and fell from the car, and thereby badly bruised,
mashed and cut his head end scalp, and masned, bruised and
L ( crushed his shoulder, shoulders, neck and breast,.wnich said
injuries are permanent and cause.him greet physical pain and
suffering, all of thisj injuries were caused solely by the
negligence and carelessness of the defendant's agents, ser- 1
vents and employee superior in authority over the plaintiff in
running the said hand car at too high a rate of speed, all to
his damage in the sum of $5000.00.

The plaintiff, Hige White, who sues as the next friend
of Samuel White, states that he is a resident of this state, and
is free from all disability, and that the said Samuel White
has no guardian, curator or committee residing in this state.

Wherefore plaintiff prays Judgment against the defend—
ant,.for the sum of $5000.00 in damages, and his costs herein
expended, and for all proper relief.
