Dear Sir:-

Pleasa refer to letters exchanged relative
to the refusal of the Kitchen Timber Company of Ashland,
to pay bills anmunting to §544.?5, they setting up the
claim that we had coupled another track to theirs, and
that we have been using the siding for other purposes

There is nothing WheteVer in their statement .
that we have permitted a track to be coupled to theirs,
nor is there anything in the contract that would urohibit
such unless there would be 1nteri'erence to their business.
The closest track to theirs is at Barking, a distance of
ever oximate ‘.y one mile .

The mailway Company has loaded three or four
cars of ties on their track at Trailer and I am advised
by the management that the mailway Company reserves the
right to use any track when it does not in any tay interfere
with the use by the owner. In loading the cars rererred
to there was no interference whatever to the business of
the Kitchen Timber Company.

‘ While we do not desire to institute suit I am
attaching bill received from the Auditor of Disbursements
which sets out the source of the emerges which the Company
rightfully claims, and from which you will note that the
total is now 9557.%9 instead of 9544.75. Will you not -
make another efiort to have them furnish you with certified
check ior the amount we claim, and if you are unable to
secure it advise further and the matter will be handled
for suit.

Gentlemen:

i have heretofore written you on April 28th and again

on May Slst of this year, in reference to claim of Lexington &
Eastern Railway Company ( L & N R R Co.) v. Kitchen Timber Company,
but am still awaiting a reply from you to those letters. The amount
of the claim, as heretofore rendered, was $544.75, but the account,
as now stated, amounts to 9557.29. I am herewith enclosing to you
an itemized statement of the account, the correctness of which can
readily be verified by you. On behalf of the Railway Company, I
ask that you kindly favor us with a remittance, preferably by cer-
tified check, to cover the amount of this claim, to-wit: $557.29.

In this connection, permit me to add, in reference to the
complaints set forth somewhat vaguely in your letter of April 20,
1915, addressed to me, (1) that inquiry of the Railway management
by me fails to show any violation by the fiailway Company of any
agreement it may have had with you covering switch, and (2) That
there has been no Violation or the switching agreement in the manner
stated in your letter, to-wit: By putting in a second switch near
the switch at Trailor, or by loading cars on this switch without
the consent of the Kitchen Timber Go. My information is that the
utmost length to which the Railway Company has gone in resPect to
these matters has been to locate a track at Barking, a distance of
approximately one mile from the Trailor siding, and to load three
or four cars of ties on the switch at Trailor, but without in any
way interfering with the use of the siding by the Kitchen Timber Co.m

i have failed to discover anything in the contract between
the nailway Company and the Kitchen Timber Company which would

. forbid the Railway Uompany from establishing a switch or sidetrack
at Barking, or at any other point near the Trailor switch, and find
nothing in said contract that would nrohibit the use of the Trailor
switch by the Railway Company for purposes oi'its own, provided such
use by the hailway Company did not unreasonably interfere with the
use of the Trailor switch by the Kitchen Timber Comoany or with the
busine s of the Kitchen Timber Company in connection with said switch.
If I am mistaken in this, I shall be obliged to you if you will

kindly point out to me, with reaSJnable promptness, wherein the ‘
contract or agreement reierred to forbids either the establishment ,
of anotier switch or sidetrsck near by or the temporary and casual
use of the Trailer switch by the nailway Company.
Assuming that there is no sufficient iround for these ob—

. jections and that neither of then constitutes any breach of any
contract or agreement between the hainay Company and the Kitchen
Timber Company, I have again to ask that you kindly ravor us with
a ranittance in full to date.

Enclosures received with yours of the 50th ult.
relative to our claim amounting to $557.29 against the Kitchen '
Timber Company, of Ashland, Ky., graningwout of construction
of certain Spur track at Trailor, Ky., a station on the Lex—
, ington and Eastern Railway, are herewith returned.
Of course the position taken by Mr. Kitchen in
.. this matter is wholly untenable. Unless Mr. McDowell, by a
§ persOnal COnference can so present the matter to him as to
5 bring him to a realizing sense of his obligatiOns in the prem—
> ises there is nothing for us to do but begin legal proceed—
:7 ings to collect that which is legally do us. As a matter of
[course Mr. McDowell is entirely faufiliar nith the whole centro-
’ fversy and it is probable he will not object to seeking an inter—
; View with Kitchen to the end that we will be saves the annoyance
: and expense of litigation. if the Lumber Company is solvent
I do not see how there can be any doubt about the result of a
law suit. If you cOncur in the suggestion above made please
‘V refer all papers which you have to Mr. McDowell with any sug-
gestions you may have to offer. I am not sufficiently familiar

with the details of our account against the Lumber Company
to be able to say whether or not the prOposition contained
in the last paragraph of Mr. Kitchen's letter above mentiOned
is one which the Railroad Company can afford to accept, but
Mr. McDowell will know about this. The suggestion contained
herein is on the assumption that the proposition submitted
cannot be accepted.

Gentlemen:-
I We have your letter of Sept. 24th,
relative to the contract between Kitchen Timher
, Company and the L & E Railroad for the construction
of a switch at Trailer, Ky.
We entered into this contract with
the understanding that we were to do all the grading
and furnish the ties, which we did, and that the
L & E was to lay the steel and charge us with the , *
actual cost of Sons.
The switch is not over 150 feet long,
as it will not hold over two or three cars at a time,
and a charge of 9557.29 is entirely unreasonable for
the amount of work that they did. We did not agree to
pay them a profit over the actual cost of said con-
struction.

f It was furthered agreed by contract
j and by letter that this switch was to be controlled
- by us, and that the general public would not be
g allowed to uSe it without our consent. The L d 3 ‘
g has allowed different shiopers to use this switch on '
3 different occasions without our permission.
We will be very glad to settle this
matter without litigation, and are willing to pay a
reasonable pricc ior the work that they did, and got
the matter settled no. But as stated before, we did
,not agree to pay them a proiit, and the switch was '
ito be for the use of the Kitchen Timber Company and
; not for the use of the gcncral public.
' We might further state that we would
be willing to pay @250.00, and turn the switch_over
to the L & E after we have finished our work there
which will not be very long.
