ing the hollidays. On my return the petition in the 1m Crawford suit
could not be found, but they turned up on the first day of the court,
when I made a motion for a rule against plaintiff to execute bond for
costs. On Jany 9, 1917, I took a rule against plaintiff a copy of
which I herewith inclose. This comprises all the steps in the latter
suit. I have a rule against plaintiff to verify in Susan Csudill suit.

' The papers in the in Crawford case are not in the clerks office, and
the clerk is of opinion that our esteemed friend J.J.hcheniel has
them. I do not remember the amount sued for , but recall that the
petition does not state a cause of action.
I am of 03inion that both of these suits were brought
with the View of getting a smell sum on compromise, and unless the
investigation file shows liability, I would not suggest any Comprc~ ‘
miss. The chances are that at the July term, I may be able to have
the rule made absolute on calling of ease and suit dismissed. The
misterious disappearance of the papers on two occasions is somewhat

Plaintiff states that the defendant, Louisville & Nashville
3 Railroad Company, is a corporation created under the laws of the state
of Kentucky, with power to sue and be sued, to contract and be contrac-
ted with. 1
Plaintiff states that on or about August 21st,1916, the defendant
1 - without her knowledge or consent employed her infant son, and caused
him while at work at the yard in the city 0f fianksnn Lexington, Kentucky
by and through their Gross negligence in failing to furnish reasonably
sufficient ferns and efficient force to assist him in handling heavy_
tee raols, caused her to lose his services in whole or in part until
he becomes 21 years of age, of the reasonable value of $1000.00.

These cases grow out of the same accident and have
been investigated and reported tosether by Mr. Landrum. The
Crawford case is for personal injuries and the Caudill case
is for loss of services of Susan Oaudill, the mother of Willie
Crawford by a former husband.

The investigation of this case is not as complete as
I would like to have it, but I am sending these papers to you

along with several others, and I wish you to have the benefit
of the information contained in this file before passing upon

Eal others. You will note that my. Landrum states that the
accident in this case seems to be due to the fact that when the
rail was dropped it bounced on this man's foot. If this is
the manner in which the accident happened, it would seem that
. this case is within the rule laid down in Truesdale v. Q:%n9fnlu
'& 159 Ky. 718, but the facts have not been brought out sufficient—

These cases grow out of injury sustained by Willie

‘ Crawford at Lexington, Ky., on the 25rd day of August, 1915, V!
while employed as a laborer under Foreman W. S. Layne.

At the time of this accident this gang was employed
in putting in new crossover from the L & E track that leads from
yard at Netherland to the old L & E freight house in Lexington;
After the crossover was put in service the old L & E track was

- used as a main track between the yard and the crossover and
the crossover was used to turn the trains onto the C & 0 main
track;after this track was put in service it was used by all

-: Susan Caudill v. LdN. RR. 00., Breathitt Circuit Court :-

I return herewith your letter of the 2nd inst., and papers received
therewith, relative to the above styled case, which is now develops grows
out of loss of services of Willie Crawford, son of Susan Caudill, injured
here near Lexington, August 25rd, 1915. I am also enclosing Mr. McDowell's
file covering this inJury, and also statement of Dr. W. O. Bullock, of Lex-
ington, who saw Crawford only one time at the boarding cars of Extra sang
Foreman Lane. From Dr. Bullock's statement you will note that Crawford
gave his age as 21 years; and that he had a severe contusion of his right
foot, but no broken bones. Dr. Bullock has no personal recollection of
this case, and his statement is based entirely upon his "57" report made
at the time he saw Crawford.

By referring to Foreman Lane's "53" report you will note that he also
shows Crawford's age as 21 years. Crawford, it seems lost 17-1/2 days
time on account of this injury to his foot and returned to work for Lane
after losing that number of days. Roadmaster Nickerson's office advises
me that Extra Gang Foreman Lane is now working on the W. & I., near Sloan,
Ky., but suggest that you communicate with Supervisor Applegate, who can
tell you definitely where you can locate Lane. In looking over the pay.
roll covering Lane's gang for the month of January, this year, I find that
Willie Palmer, mentioned as a witness to this Crawford accident, is still
with Lane as assistant foreman, but neither Keemkggis nor Matt Lawson, also

I have dropped this case from my list of cases on hand, as
the investigation will have to be completed on the W. & I.

 Statement of Dr. W. 0 Bulllck, residence Lexington, Ky., made to
H. T. Lively at Lexington, February 7th, 1917 relative to case of Susan
Caudill v. L&N. RR. 00.

My records show that Isaw this Crawford boy only the .
one time, that on August 23rd, 1915, the date of his injury. I saw him
at the boarding cars of Foreman Lane. Crawford gave me his age as 31
years old. Crawford had a severe contusion of the dorsum of the right
foot. There were no broken bones according to my records. I do not
have any special recollection of this case, and this statement is made
wholly from my records. I saw this boy only the one time.

The above statement is correct.
