value of cow killed ‘ebruary 25th. I find that all papers from the
Claim Agent were not sent., and further that the last Clause of my letter
does not indicate what was to be said. It should have read, " but
that amount Was offered", instead of "Due".

America Terrill to recover $100.00 for the alleged value of
cow killed on February 25th, 1917. Please note report attach-
ed. The Claim Agent informs me that although not legally
‘ liable over $50.00 the appraised value by three disinterested
. men, Brown Johnson, Chas. Deaton and Lane Beaten qho live at
Chavies but that that amount was due.

vs. / Petition.
The Louisville d Heshville Reiered Company Defendent.

The plaintiff, America ierrill, states that the defendant,
the Louisville and heehville Railroad Company, is a corneretion
organized, created and existing under and by virtue of the laws of
the state of Kentucky, and as ouch it has power to contract and to
be centrected with, to sue and Le sued in its corporate name,

I "the Louisville and Elashville Z‘Cuieru-i Company".

The plaintiff, America Ierrill, for her cause of action ' .
herein against the defendant conteny says that it owns and operates
e line of railroad running through Perry County, Kentucky; that
on or about the 25th day of hehruary, 1917, e cow owned by this
plaintiff, of the value of one hundred dollars, (3100.00), strayed
on the track of the defendant company near Chevies, in ferry
County, Kentucky; that defendant, by its agents, servants, hired

' hands and employee in charge of one of its trains so carelessly
and negligently managed and operated one of its engines and the
cars thereto, that the came ran over and killed said cow, to the
plaintiff's damage in the sum of 3100.00.

rlaintiff says that defendant company's track at
Chevies, Kentucky, and at the point there said cow was killed

_ has never been and is not at this time fenced or inolosed in
any manner,end was not fenced or inclooed at the time of the
killing of acid cow.

Plaintiff hays said cow wee reasonable worth one
hundred dollars at the tine ehe was killed by defendant connany;
that she and her family have suffered much loss and inconvenience
doing Without the milk of said cow; that she believes she ought

 to recover of defendant company for said logo, the gum of ”100.00.

jufigmeht againat the defendant, Louigville and Nashville Railroad
Company, in the mum of ?lO0.00; for her cost in this action ex-
panded, and for all equitable and appropriate relief to which She
