recommend such action to the Vice President for Student
                Affairs.

        c.    If a student is subjected to criminal prosecution and
               the University Judicial Process for an offense which
               is a violation of both this code and federal, state,
               or local law, the University J-Board may direct that
               disciplinary sanction imposed by the University be
               mitigated by any penalty imposed by off-campus authorities.


1.422    The lU. J-Board shall consist of twent--six persons and a
         Hearing Officer; five representatives frorn the College of
         Arts and Sciences, three representatives from the College
         of Education, two representatives from the Graduate School,
         two representatives from the College of Business and Economics,
         two representatives from the College of Engineering and one
         representative each from the following colleges: Agriculture,
         Allied Health Professions, Architecture, Dentistry, Homne
         Economics, Law, Library Science, Medicine, Nursinq,
         Pharmacy, Social Professions and Lexington Technical
         Institute .

         a.    The Hearing Officer shall be the Chairman of the Board
                and he shall convene meetings of the Board at such times and
                places as necessary to carry out its duties. The Hearing Officer
                shall be a non-votinq member of the Board as to the issue of
                guilt or innocence and as to the quantum of punishmnnt, but
                shall decide and rule upon all questions of law, whether they
                be substantive or procedural, and upon all procedural
                questions arising under the Code. The Hearing Officer
                shall neither sit in on nor take part in the Board's deliberations
                of the issue of innocence or guilt nor quantum of punishment.
                He shall be available to advise upon procedural questions
                arising under this Code.

         b.     In notifying representatives of the University and an
                accused student that a hearing date has been established,
                the Hearing Officer will also indicate a date, time and
                place at which a Board of six members shall be randomly
                selected from the pool of twenty-six names arrived at
                through the appointment process set forth under 1.424.
                The date for Board selection by the Hearing Officer shall
                be at least forty-eight hours prior to the established date
                of hearing, and representatives of the University administration
                and the accused may observe the selection process.
