MEMORANDUM


TO:         President Otis A. Singletary

SUBJECT:    Revisions in Code of Student Conduct Recommended by Board Committee





Members of the Student Affairs staff and I have completed a thorough review of the report
submitted by the Committee on Revision of the Code of Student Conduct at the March 21
meeting of the Board of Trustees. Several of the proposed revisions have great merit,
and there are others to which we have no substantial objection. However, this memorandum
is not addressed to such items. Rather, I wish to bring to your attention the problems and
questions that would be entailed in the Board's adoption of certain proposed revisions; and,
in some cases, I wish to recommend Board action concerning the Committee's proposals.

I have organized the following presentation into five divisions: (a) proposed revisions which
should be rejected; (b) proposed revisions which should be amended; (c) proposed revisions
which involve considerations that should be brought to the Board's attention; (d) Mr. Wendels-
dorf's minority report; and (e) Mr. Bell's minority report.

A. Proposed revisions which should be rejected.

    It is my considered judgment that the Committee's proposed revisions outlined below
    should be rejected by the Board, for the reasons given:

    1. 2g (Providing that "opportunity to comply with a lawful order to leave
          the premises must be given" as a condition for finding a student
          guilty of violation of Section 1. 2g)

          BOARD ACTION RECOMMENDED: That the proposed additional
          sentence to 1. 2g be rejected and the original wording of that section
