I f o u n d also that the r e g u l a t i o n of the b o d y of gentlem e n c l a i m i n g to be the K e n t u c k y l e g i s l a t u r e was p u r e l y a r b i t r a r y b ecause m ade w i t h o u t l o o k i n g at a l l i n t o the e v i d e n c e . It i s n ot a p l e a s i n g t h i n g to say, but I feel c o n s t r a i n e d f r o m a s ense o f d u t y to say that the a c t i o n of that b o d y was s u c h that it o u g h t n o t to be r e s p e c t e d i n a n y c o u r t as a j u d g m e n t u p o n the quest i o n i n v o l v i n g i m p o r t a n t r i g h t s , s u b m i t t e d to it for d e c i s i o n , b u t a s a c t i o n t a k e n w h o l l y o u t s i d e of a l l l a w , a n d i n c o n t e m p t of t he c o n s t i t u t i o n a l r i g h t s of f r e e m e n to s elect t h e i r r u l e r s . The r e c o r d justifies the belief that that b o d y was w h o l l y i n d i f f e r e n t a s to the n a t u r e of the evidence a n d that there was a fixed p u r pose o n its part to put G o e b e l i n t o office a n d oust T a y l o r , reg a r d l e s s of the p r o o f i n the c ase. I f a n y r e g a r d w h a t e v e r had b e e n p a i d to the evidence no c o n c l u s i o n f a v o r a b l e to G o e b e l c o u l d h ave b een r e a c h e d o n a n y g r o u n d u p o n w h i c h the b o a r d of c ontest o r the b o d y c a l l i n g itself the l e g i s l a t u r e h a d j u r i s d i c t i o n t o d e t e r m i n e the c o n t e s t s . " H e a n n o u n c e d that in his o p i n i o n the j u d g m e n t s h o u l d be reversed.

C o l l i e r t o d i s m i s s the m i l i t i a o n g u a r d at the s tate h o u s e a n d to s u r r e n der his office to G o v . B e c k h a m ' s a d j u t a n t g e n e r a l . T h e r e p u b l i c a n s t a l k e d at once of r e n o m i n a t i n g T a y l o r for g o v e r n o r f o r the r e m a i n d e r of the u n e x p i r e d t e r m at a n e l e c t i o n w h i c h t h e y dec l a r e d m u s t t a k e place i n N o v e m b e r , 1900, t i n d e r a p r o v i s i o n i n t he c o n s t i t u t i o n . E x - G o v . B r a d l e y stated that a p e t i t i o n for a r e h e a r i n g w o u l d b e filed.
