PREFACE
The Inventory of Federal Archives in the States is one of the prod-
ucts of~the~workWFf"the`Surv¥5F7ifwFede}alFArchives, which operated as a
nation—wide project of the Works Progress Administration from January 1,
1956 to June 50, 1957.
The plan for the organization of the Inventory is as follows:
Series I consists of reports on the administration of the Survey, ac-
knowledgments, and general discussions of the location, condition, and
content of federal archives in the states. Succeeding series contain
the detailed information secured by workers of the Survey, in inven- A
tory form, a separate series number being assigned to each of the ex-
ecutive departments (except the Department of State) and other major
units of the Federal Government. Within each series No. l is a general
introduction to the field organization and records of the governmental
agency concerned; the succeeding numbers contain the inventory proper,
separate numbers being assigned to each state in alphabetical order.
Thus, in each series, the inventory for Alabama is No. 2, that for
Arizona No. §, that for Arkansas No. h, etc.
For each local office information regarding each series, or unit of
related records, is presented in the following order: title, inclusive
dates ("to date" indicating an open file at the time the information
was secured), general description of informational content, description
of the system of filing or indexing (if any), a statement of frequency
and purpose of use, form of the record itself (bound volumes, sheets in
folders, etc.), linear footage, description of the containers, physical
condition of the records (not stated if satisfactory), location by room
number or other identifying information, and finally, the number of the
Form 58SA on which this information was originally recorded by a Survey
worker and from which it was abstracted for the Inventory, This form
is on file in The National Archives. When it contains substantial in—
formation on addenda sheets which has not been included in the mimeo-
graphed abstract, indication of this is given by use of the reference
"See addenda."
In Tennessee the work of the Survey was under the direction of Judge
Samuel C. Williams with Mr. Lowe Watkins, who later succeeded him as
director, as his assistant. In.lby‘lQ57, Tennessee was added to the
region under the direction of Mr. Stanley C. Arthur of New Orleans, La.,
with Mr. John S. Luton as state supervisor. This Inventory of the rec-
ords of the Federal Courts in Tennessee was prepared in the New Orleans
office of the Survey under the direction of Mrs. Norris Fazekas,
· editor—in—chief and supervisor, and was edited before final typing by
Dr. Richard R. Stenberg of the Washington office.

INTRODUCTION
The state of Tennessee was created by the Act of June l, 1796. A
district court was established by Act of January 51, 1797, with one
judge, who was to hold annually four sessions of court. Court was to
be held alternately at Knoxville and Nashville. By Act of February 17,
1799 Congress provided that persons accused of crime on the east side
of the Cumberland Mountains should not be held to answer at the court
at Nashville or any other place on the west side of the mountains, and
that any one committing a crime on the west side of the mountains, A
within said district, should not be held to answer at the court of
Knoxville or any other place upon the east side of the mountains, but
should be held to answer in the court at that side of the mountains l
where such offense was committed. The same provisions as to jurisdic-
tions and civil matters were provided. Section three of the act set
the western foot of the Cumberland Mountains as the boundary dividing T
the jurisdiction of the eastern from the western side. 1
The state was divided into two districts by Act of February 15, 1801.
That part of the state which lies on the east side of Cumberland Moun-
tain was designated the District of East Tennessee; the remaining part
of the state was called the District of West Tennessee. The act also ,
created various circuits, with East Tennessee, West Tennessee, Kentucky, .
and Ohio composing the Sixth Circuit.
An Act of April 29, 1802 provided that the judge should hold four
sessions of court: two at Knoxville, Eastern Tennessee, on the fourth
Mondays of April and October, and two at Nashville, Western Tennessee, v
on the fourth Mondays of Nay and November.
A district court for the Western District of Tennessee was estab-
lished by Act of June 18, 1858, and includes Benton, Carroll, Henry, T
Obion, Dyer, Gibson, Lauderdale, Haywood, Tipton, Shelby, Fayette, 7
Hardeman, McNairy, Hardin, and Perry Counties, with court to be held 1
annually on the third Monday of September at Jackson. The court was
invested with the same powers as the district courts of Eastern and i
Western Tennessee. By Act of June 18, 1859, which was an amendment J
to the Act of June 18, 1858, the counties of Madison, Henderson, and 1
Weakley were added to compose the district of Western Tennessee; and 1
the residue of the counties of Tennessee, formerly composing the Dis- Y
trict of Western Tennessee, were incorporated into one district called {
_ the Middle District of Tennessee. It was stipulated that court should T
be held at Jackson. On July ll, 1862 court was removed from Jackson to
Huntingdon in the Western District; and on January 26, 186h from J
Huntingdon to Memphis.
The Act of June 25, 1868 provided that court should be held at
Knoxville for the Eastern District, Nashville for the Middle District,
and Memphis for the Western District. The Act of June lh, 1878 pro-
vided for the appointment of a district judge for the Western District
of Tennessee, to hold terms of court at the times and places required
by law and to exercise the same power and jurisdiction as conferred
upon the judge of the Eastern and Middle Districts.
In 1878 the Western District was divided into two divisions; Eastern

and Western, with court at Jackson in the Eastern Division and at
Memphis in the Western Division. These divisions have continued. The
Western Division is presently composed of Dyer, Fayette, Haywood,
Lauderdale, Shelby, and Tipton Counties. Terms of court are held at
Memphis on the first Mondays of April and October. The Eastern Division
is now composed of Benton, Carroll, Chester, Crockett, Decatur, Gibson,
Hardeman, Hardin, Henderson, Henry, Lake, M Nairy, Madison, Obion, Perry,
and Weakley Counties. Terms of court are held at Jackson on the fourth
Mondays of March and September. The same judge presides over both di~
visions of the Western District and the clerk of the Western Division
is also clerk of the Eastern Division, whose office is operated by a
deputy clerk. Records of the two divisions are intermingled. O
By Act of June ll, lBPO the Eastern District was divided into two
divisions, Northern and Southern, with court to be held at Chattanooga A
in the Southern Division and at Knoxville in the Northern Division. A
The Northeastern Division of the Eastern District was established by
Act of February 7, TQOO, with terms of court at Greeneville. These di-
visions have continued. The Southern Division is presently composed of A
Bledsoe, Bradley, Hamilton, James, Marion, McMinn, Meigs, Polk, Rhea, l
and Sequatchio Counties. Terms of court are held at Chattanooga on the
fourth Monday of April and the second Monday of November. The Northern
Division comprises the counties of Anderson, Blount, Campbell, Claiborne,
Grainger, Jefferson, Knox, London, Monroe, Morgan, Roane, Sevier, Scott,
and Union. The court sits at Knoxville on the fourth Monday of Nay and -
the first Monday of December. The Northeastern Division has jurisdic-
tion over Cooke, Greene, Hamblen, Hancocke, Hawkins, Johnson, Sullivan,
Unicoi, and Washington Counties. Court is held at Greeneville on the
first Monday of March and the third Monday of September. l
The Middle District is now composed of four divisions: the Nashville T
Division, which was formerly the court seat for the entire Middle Dis- A
trict; the Northeastern Division which was established by Act of Febru~ y
ary 15, TQOQ; the Winchester Division which was created through Act of A
June 22, T9l6; and the Columbia Division which was established by Act of A
hhrch h, TQ2§. Each division of the court convenes at the place desig- i
nated, the Northeastern Division convening at Cookeville. One judge l
presides over all divisions of the courts in the Middle District and all y
records of the four divisions are kept at Nashville. The Nashville Di- A
vision is composed of Cannon, Cheatham, Davidson, Dickson, Humphries, T
Houston, Montgomery, Robertson, Rutherford, Stewart, Sumner, Trousdale, l
Williamson, and Wilson Counties. Terms of court are held at Nashville
· on the second Monday of March and the fourth Monday of September.
The Winchester Division is composed of Bedford, Franklin, Lincoln,
Warren, Grundy, Coffee, and Moore Counties. Court is held at Winchester
on the first Ebnday of April and the third Monday of November. The
columbia Division includes Hickman, Giles, Lawrence, Lewis, Marshall,
Wayne, and hhury Counties. Court is required to be held at Columbia on
the third Dbnday of June and the fourth Monday of November. The North~
eastern Division presently comprises the counties of Clay, Cumberland,
Dekalb, Fontress, Jackson, lhcon, Overton, Pickett, Putman, Smith,
Van Buren, and White. Terms of court are held at Cookeville on the third y
Monday of April and the first Monday of November. `

The court was housed in the old Courthouse at Main and Gay Streets I
from.l8!£ to 187h, and in the old Post Office Building, Clinch and I
Market Streets, from 187h until 195h, when it was moved to its present
location. All records prior to 18§h_were removed in 1865. Information I
as to what disposition has been made of them.is not available. Useless I
papers are retained for ten years, and then destroyed in accordance with ~
regulations governing their disposal.
