         Minutes of the Meeting of the Board of Trustees of the University
of Kentucky, May 16, 1958.


         The Board of Trustees of the University of Kentucky met in the
President, s Office at 9:00 a. m., CST, Friday, May 16, 1958, with the
following members present: Governor A. B. Chandler, Chairman; Mrs.
Paul G. Blazer, Dr. Ralph J. Angelucci, Ben Butler, Dr. Paul Hall,
Wood Hannah, Sr., R. P. Hobson, Robert R. Martin and J. Stephen Wat-
kins.  Absent: Robert C. Stilz, Carl Dempewolfe, Louis Cox, W. F.
Foster, Dr. Daniel C. Elkin and Harper Gatton. President Frank G.
Dickey and Secretary Frank D. Peterson met with the Board,



         A. Called Meeting.

         The Notice of Special Meeting sent to all members of the Board
of Trustees more than ten days in advance of the meeting was read and
authorized made of record.


                  NOTICE OF SPECIAL MEETING
                               of the
                       BOARD OF TRUSTEES
                               of the
                    UNIVERSITY OF KENTUCKY


                 The Board of Trustees of the University of Kentucky
         at its meeting on April 1, 1958 adjourned to meet on May 20,
         1958, This date conflicts with the dates of the Governors,
         Conference.

                 The undersigned, as Chairman of the Board of
         Trustees of the University of Kentucky hereby gives notice
         to all of the members of said Board that a special meeting
         is hereby called, and will be held in the usual meeting
         place of the said Board of Trustees, the Administration
         Building on the campus of the University of Kentucky, Lex-
         ington, Kentucky, on the 16th day of May, 1958 at 9:00 a. m.
         CST, for the following purposes:

                 A, To consider and approve recommendations
                    of the faculty on candidates for degrees.

                 B, To consider and act upon staff and faculty
                    changes and appointments.

                 C. To consider and act upon current financial
                     problems,

                 D. To consider and act upon routine contracts and
                    extensions of contracts.

                 E. To consider and act upon the site of the Harlan
                    County Extension Center,

                  F. To transact such other miscellaneous and in-
                     cidental business as may be brought before
                     the meeting at that time.

                  G. To consider and act upon bond resolution for
                     small dormitory. Given at Frankfort, Ken-
                     tucky this the 28th day of April, 1958.

          The Secretary reported that all members had acknowledged re-
ceipt of the Notice and those not present had explained their inability to

Dear Doctor Dickey:

           I am submitting herewith the Financial Report
of the University covering fund transactions for the ten-
months period ended April 30, 1958, consisting of a balance
sheet and relating financial statements.

           The general fund income received is $11, 832, 742. 65,
which is $25, 238. 79 in excess of the budget estimate for 1957-
58.

           Current fund expenditures and encumbrances out-
standing for the period totaled $9, 769, 086. 95 or 82. 1% of
the departmental appropriations of $11,902, 292. 62.

          E. Sale of Surplus Property.

          President Dickey reported a list of discarded and obsolete items
of furniture located in the men, s and women, s residence halls, some old
phonographs, parts of two old pianos, and other items having the appearance
of junk, located in the Fine Arts Building.

          He further reported one small power unit, gasoline engine driven,
located in the College of Engineering, surplus to the needs of that College,
and recommended that these items be authorized sold or disposed of.

          Upon motion duly made, seconded and carried, the Board con-
curred in the recommendation of the President.



          F. Accident to Car.

          President Dickey reported a car accident on the Experiment Station
Farm. He stated that the car of Mr. James Thorndale, of the Agronomy
department, was damaged by a tractor and hay baler driven by James Bryant,
a mechanic in the Agricultural Engineering department, The Thorndale car
was parked, and Mr. Bryant did not allow enough room between the vehicles.
The cost of repairing the car amounted to $80. 00.

         President Dickey stated that the University was exceedingly annoyed

Acting Dean and Director of the Experiment Station, he was recommending
that the cost of the repairs be paid from the Experiment Station funds, with
the explicit understanding that the University does not admit negligence or
liability in paying the accounlt.

understanding that the University does not admit negligence or liability in
paying the account.


          G. Report of Injuries.

          President Dickey reported an injury to Hubert Kidwell, an employee
of the Division of Maintenance and Operations. Mr. Kidwell was moving a
typewriter desktothe paint room, when the typewriter carriage snapped back
and caught his finger.  He reported to the University Health Service where
an x-ray was taken.  The University Health Service submits an invoice
for $1. 50.

          President Dickey reported an injury to Carl Swinford, an employee
of the Division of Maintenance and Operations.  Mr. Swirnford was involved
in the building of a cattle mineral feeder, running a board through the 6"1
jointer, when his hand slipped.  The finger next to the little finger of his
left hand had the end cut off. Apparently, the bone was not cut, but about
one-half inch was cut from the nail..  Mr., Swinford reported to the Uni-
versity Health Service and was referred to Doctor Sprague for treatment.
Doctor Sprague submits a bill for $ 10. 000

          President Dickey reported an injury to Charles E. Baierlein, an
employee of the Division of Maintenance and Operations.  Mr, Baierlein
was checking a new exhaust fan, when his hand was pulled into the end of the
blade.  The tip of the blade cut the back of his small finger, partially
severing the tendon. He was taken to the Good Samaritan Hospital for
emergency treatment.  The Hospital rendered necessary services and subs
mits an invoice for $13 00.

          President Dickey recommended that these accounts be paid, with
the understanding that the University did not admit negligence or liability.

          Upon motion duly made, seconded and carried, the recommenda-
tion of the President was concurred in and the invoices authorized paid, with
the understanding that the University does not admit negligence or liability
in the cases of Hubert Kidwell, Carl Swinford or Charles E. Baierlein.


          H. Death Termination of Pay,

          President Dickey read the following communication and proposed
Re solution:

             Whereas KRS 164. 225 empowers the Board of Trustees
          of the University of Kentucky to fix the compensation pay-
          able to University employees out of the State Treasury or
          otherwise, and

              Whereas the responsible administrative officials of the
          University are required under existing law to certify that
          the duty and services compensated for have been rendered
          bv the employee, and

             Whereas University employees should be fully compen-
         sated for the duty and services rendered prior to death al-
         though they die during a monthly pay period,

             Now Therefore Be It Resolved:

             That final compensation in the case of death of University em-
         ployees shall be computed and certified according to the fol-
         lowing formula:

                 Where applicable the employee, s annual salary
             shall be composed of two increment3: 5/6 for the 9
             months, school term, September 1 to May 30 (usual-
             ly paid in 10 equal installments) and 1/6 for the
             summer session of 8 weeks (usually paid in 2 equal
             installments)  When death occurs his final compen-
             sation shall be sufficient to pay for whatever fraction
             of the school term has been completed and whatever
             fraction of the summer session has been completed.

             And be it further resolved that the Vice-President,
         Business Administration, is authorized to establish such
         regulations and payroll practices as are necessary to give
         this formula effect.


         President Dickey explained the purpose of the Resolution.

         Members   of the Board being thoroughly sympathetic, upon motion
duly made, seconded and carried, the Resolution was authorized adopted,
effective immediately.



         I. ICA Conxtract Approved.

         President Dickey submitted contract between the Experiment Station
of the University and tihe International Cooperation Administration, the con-
tract known as PIO/P 9 1-81-00 -1.70640, Pakistani V-Aid Team.

         President Dickey stated that the contract referred to about 20 foreign
nationals receiving training on the campus of the University, and maybe at
other institutions, for a period of 121 weeks originally and later changed to
a period of approximately 19 weeks. The total would amount to about
$13, 165. 00, which sum is to go to pay the cost of the University administer-
ing the program.

         The President recommended that the original contract and the ex-
tension amendment be authorized and approved,

         Upon motion duly made, seconded and carried, the contract as
originally submitted and the amendment were authorized approved and accepted.

      J. Contract with United States Forest Service Approved.

      President Dickey submitted Supplement Noi. 5 to Basic Contract be-
tween the Kentucky Agricultural Experiment Station of the University of
Kentucky and the United States Forest Service, He explained that the sup-
plement would grant an additional $1, 000. 00 for the cost of cooperative
project between the two uni'ts  He recommended its approval.

      Upon motion duly made, seconded and carried, Supplement No. 5
to Basic Memorandum of Understanding, dated October 21, 1953, between
the Kentucky Agricultural Experiment Siation and U. S. Forest Service was
authorized approved.





      K. Loan Agreement with Housing and Home Finance Agency Approved.

      President Dickey stated that the Executive Committee, at its meeting
on March 14, had approved Loan Agreement with the Housing and Home
Finance Agency on Project No, Ky. 15.-CH.-26(D), University of Kentucky,
Lexington, Kentucky, Contract No. H-302-152, but that the Housing and
Home Finance Agency desired that same be approved by the full Board.  He
requested that the following be approved and authorized made of record:

          Mr. Peterson submitted a Loan Agreement on Project No.
      Ky. 15-CH-26(D), University of Kentucky, Lexington, Ky., Con-
      tract No. H-302-152, whereby the United States of America
      Housing and Home Finance Agency agrees to loan on the above
      reference project the sum of $1, 800, 000 at a maximum interest
      rate of 2-7/8% per annum. The loan provides that the bonds
      shall be offered for sale to the public, upon which invitation the
      Federal Government will bid par for the entire issue at an av-
      erage interest rate of 2-7/8% per annum. Mr. Peterson stated
      that the provisions of the negotiated loan are similar to those
      heretofore approved and that he and counsel agree upon the
      provisions contained therein, and recommended that same be ap-
      proved and authorized executed on. behalf of the University of
      Kentuc kyv


      Upon motion duly made, seconded and carried, the action of the Execu-
tive Committee on March 14 was ratified and approved, and the Loan Agree-
ment above referred to was authorized and approved,




     L. Purchase of Forty--Four Acres in Owen County.

     President Dickey recommended the purchase of a strip of forty-four
acres which joins the field on the west side of the Eden Shale Farm in Owen
County. He stated that the Owen County Citizens Committee had agreed
to supply $1, 000 to the purchase price, and the University would pay the bal-
ance of $2,800.  President Dickey read the following communication.
