to Prestcnrtura. Er. Harkins insisted on my
settinr off at Prestonsburr and going over and going
through his house, that he said was just about
completed. 1r. Harkins said that he had the
finest house in the Big Sandy Valley and the best
material in it.

Q.— 7 Did hr. Harkins know that you were connected with the
Ashland Lumber Company?

A. He did.

Q — 8 At the time you speak of having the conversation with
hr. harkins in reference to his house state whether
or not he made any complaint to you of the character
of lumber furnished him by the Ashland Lumber Company?

A. he did not, but on the contrary lead me to believe by
his conversation that he was more than satisfied with
the quality of material furnished him. _ I

A. We did not. We work the lumber to the size. All
' lumber furnished by us and other mills in this section
is never hand cleaned, except panel work and steirways,
\ newel posts and railings. This has to be done
because after the lumber is put together in that shape
it is impossible to clean it, therefore all stairways .
that have panel work is cleaned in the shop and prices
made accordingly, with the exception of the tréas and
‘ rises for the stairways.

tenement houses, purchased by lr. harkins is embraced
in the charge or balance, which the Ashland Lumber
Company are now trying to recover in this suit?

A. It is not.

Ashland Lumber Company from the defendant, Harkins, on
the orders of lumber for his residence?

had purchased for tenement houses previous to selling
him lumber for his residence, but these had been paid
and settled for.

the purchase of this lumber verbal or in writing?

A. In writing. We were asked to make an estimate for
the material to be used in the construction of this
residence which,for some of the material was idwriting.

Q— 13 State what these estimates set out as to the contract
between your Company and Er. Barking?

A. Character of lumber and the prices agreed upon. The
first estimate was made July 7th, 1995, amounting to

. ¢780.00. There was also seme prices asked on some
other material pertaining to this residence that was
accepted and shipped in connection with the first
estimate and amounted to $574.70, making a total for
the two estimates given of $1,154.70.

Q - 14 State whether or not the two estimates above referred
to were the only estimates you submitted to the
Defendant, Harkins on this residence?

A. They were not.

Q — 15 For what portion of the house was the lumber of those
two estimates used?

A. They were used in the exterior finish and porch work
and some floors, embracing cornice, outside doors,
frames and window frames.

Q- 18 Did you make any other estimates for any other material
for the construction of this house except the two
estimates spoken of?

A. I did.

A. This estimate was made September 12th, 1905, amounting

for material from the mill or were they prices for

A. The prices were made for material machined at mill
but not cleaned up ready to put up.

Q — BR Whose duty is it the mill mans or the oontractorjto
clean up this lumber to put up.

A. Accordinr to custom prevailing at our mill and all
other fills in this vicinity, it is the custom and
work of the contractor to clean up and finish the
finish, after being furnished by the mills.

Q - 27 You may state whether or not you agreed with the
defendant, Harkins, to clean this lumber ready to
put up?

A.. I did not.

Q — 28 When the estimates were made, you may state whether
or not all the lumber that was furnished to the
defendant for the constructing this house by the
Ashldnd Lumber Company was specified?

A. It was not.

Q- 29 Did you have the plans and specifiactions for the
contract of this house when you made your estimate?

A. I did.

Q ~ 50 State whether or not when that house was completed it
was completed according to the plans and specifications
furnished you?

A. In estimating the material for interior finish
according to specifications, it required the entire '
second story to be finished in yellow pine and our
estimate so stated a certain amount of this material

and that specified finish to be in yellow pine. The
doors called for in the second story were to he pine
doors and we contracted with The Sash & Door Company
to furnish those doors according to specifiactions.
The contract was complied with and the doors delivered
to Prestonsburg, according to said specifications and
after having the yellow pine, partially ready to be
worked into interior finish for this contract as

. specified, 3r. harkins stated to no that he thorght
it was to be quartered oak finish in the second story,
although my estimate plainly stated that it was to be
yellow pine and the specifications also plainly stoked
the same foot. I stated to hr. Harkins that if he
would want the second story finished in qudricred oak
that we would have to get the motorial outgdnd order
new doors for that part of the redidcncc and he asked
me to make him an estimate of what the change would
cost, and I did so and agreed to furnish quartered
oak in the place of pine in certain rooms in the
second story and to change the doors to veneered

' oak floors for the sum of $425.00 extra. hr. Harkins

to havo the pine doors that had been delivered to him
according to specifiection of the third estimate
returnel to us at Ashland, Kentucky; and there were
other slight chanfles made in the way ofilocating doors.
These changes delayed us materially in waiting on
Mr. Harkins to state whether he wanted the Parlor
finished in poplar as previously estimated or in Birch,
so as to enable the Sash & Door Company to get their
