The plaintiff, Rebert Slone, says that he is a merchant located
and ioing a general merohandise business at Dwalo Post Office in
Floyd County,Kentucky, and was so engaged on and Since the 29th.day
of October,1904,and fhafi on the let. day of November,l904,he bought
from Hutoinpillar & Sheridan, of Ironton,0hio, a hill of hardware
amounting in the aggregato to the sum of $60.70 and that on the
29th. day of October,1904, he Bought from the flame firm a bill of
zfluo tile fimounting to the sum of $1.58.

That the defendant, oheaapeaka & Ohio Railway company is a
common carrier operating a railroad between Ironton,0hio and Paintu~
villo, Kentucky,and that it is a corporation,organized and exigting
under and by virtue of the lawq of the State of Kentucky with power
and authority to sue and be sued,to contract and be contracted with
in its corporate name,chesapeake & Ohio Railway Gompawy; that as such F
Common Carrier,it on tho loo. on? of November,1904,received the said
Bill of Hardware from Hutsinpillar & Sheridan at Ironton,0hio,to be
carried by it to Plaintiff and consignee at Paintsville,Ky. and that
it isqued its Bill of Lading therefor showing receipt of said goods;

That fhe onifl Wofandfint,0hésapeake & Ohio Railway Gompany,have
unlawfully,oarelessly and negligently failed to deliver the ““ifipills
of Goods to this plaintiff; that the said defendant has unlawfully

oareloosly,anfl negligently loot,mislaid or miqo delivered the said

 goods and failed to deliver them to this Plaintiff to his damage in
the sum of $25.00 in addition to the value of said Bill of goods.

wherefore the Plaintiff prays that he recover Judgment against
the Defendant for the amount of the two Bills of Goods $62.08 with
interest thereon at the rate or 6% per annum; that he recover dauage
to the amount of $25.00; he prays for cOst and all general and
epecial relief.
