out of, the complications ‘.'Jhich have arisen with respect to the
right of way secured through the Allen tract. ‘.;;on' t you please
note also your letter of hay 8th to Eir. Wall and ygiir letter of
‘ July let to Fir. R. 1). Eubank, of Fir. Wall's office.
At the conference :29 ‘.'Ial ter S.T§ar1:ins had with Z’r.
Wall and myself in Richmond flay 13th, as I recall, Ir. Harkins
was of the opinion that a voucher should be sent for $625.00 in
favor of 1311's. Effie Duke, which, .. together wi til the E;l,375.00 you
have in hand, would make up the $2,000.00 consideration of deed
from .’.Trs. Duke, and my impression was that you were then of opin-
ion that when we got this deed all complications in respect to
B" the Allezi right of way would be cleared up.
9
I
* ljudge from your letter to Sir. Eubank, above referred
to, that l was in error, as 1' note that you are, of opinioa that
‘.’-11181711 er settlement be made with Lirs. Duke or not there is going to
be a suit with other parties as to this right of way, and that you
are unwilling to hazard an expression as to the ruling of the
court by saying that the execution of the deed from Ilrs. Duke will
. give complete and clear title to the whole of this right of way,
clear from claims of the Allen children who have not been paid
for their interest, or that it would settle all claims of every
nature against the property.
It is earnestly desired that this matter be straight-
ened out with all possible dispatch, and I would be very much
\ obliged if you would write me fully the best course to adopt.
‘~,, 1
‘ Very truly yours,

Bear Mr.Harkins:-
We have before us your favor of the 10th
in reference to the coal lands belonging to the Hamilton
Cool and Land Company and adjoining lands belonging to your
firm individually.
tofore we would feel justified in going to
the expense of an investigation of the property we would
like to be furnished with a map of the property :hich you
propose to sell showing the location also of the railroad.
Ye understood from your first letter that you
were proposing to sell the property in fee but this letter
states that you have no timber rights, which ihdicates toot it
is the mineral only which you are proposing to sell. ;his
of course makes the proposition less attractive, as timber is
getting scarcer and scarcer and more and more expensive.
fleesc send us an analysis or seams Ios.l, 2
and 4, and any other information as to the commercial value >
of these seams, for domestic and coking purposes, which you
have at hand. If this analysis is satisfactory and the other
. information which we are aeging is favorable it is provable
that we will arrange to me e a careful exoninution of the property -
in September.
