my dear hr. Harkins:
I have been waiting for i}. Kraft since he received the ab-
stracts and your letters of hay 5. I was in conference with
him this morning and furnished him a map which shows the sur-
vey and tracts of land shown by various abstracts. The Chain
of titles is so indefinite that 1 have some doubt whether or
not Mr. Kraft will pass the titles. There is one point cer-
tain - he will not pass any of the titles unless he can be
shown where the title passed from the government or the state
to some of the owners shown in the abstract.
There is hepe of doing something in this matter provided we
can show both ends of the chain, i.e., passing of the title
from the government and the present possessor as shown by the
map and the Kentucky Beaver operations. You of course realize
that pers0nally 1 have no doubt about the titles, otherwise
I would not have been interested in the preperty at any time,
but the point now is to satisfy hr. Kraft so that we can ob-
tain some money for further operations. I know that you will
assist on the above point.
Your letter of May 5 to hr. Kraft, describing hr. Coombs' con-
nection, is Very valuable and it may be that if you can show
title from the government to the owner for the remaining chain
of titles, hr. Kraft will accept hr. Coombs' opinion.
You will note by the enclosed sheet that parcels one to six,
both inclusive, are covered by hr. Coombs‘ opinion and that
parcels séven to sixteen, both inclusive, are not covered by
his opinion. If you will obtain his opiniOn that the title
is good on parcels seven, eight, nine and ten, it may be that
the others can be waived as they do not contain any appreciable
quantities of commercial coal to be mined, at least within the
time of the lease.

Dear Sir:-

Your letter of the 3rd instant received as were also the abstracts
of title which i am again returning herewith. After receiving tisse abstracts
I took up the matter with Mr.C.G.Whittier and explained to him thet in none
of these abstracts was there anything to show that the title had passed out
of the United States Government and therefore tie abstracts were not satis-
factory. It has also been indicated to me tiat some of these lands were
granted by the United States covernment to the state of Kentucky. If this is
true it would also be necessary to show that any such titles had passed out
of the state of Kentucky to individuals.

You will appreciate that in regard to titles to real estate tiet
there cannot be any such thing as adverse possession as against the united
States Government or the state of Kentucky and that while it is true that
many‘titles of real estate are based upon adverse possession for a sufficient
length of time this cannot be as a:einst the United States or the state of
Kentucky. Whether these lands were patented or passed by an Act of Congress
granting title should be made to appear by the abstracts themselves by
proper references either to the recorded patent or the particular act of
congress or act of the Legislature of Kentucky so transferring the title. -

It doubtless will seem to you tint I am rather technical in my re—
quirements but as you will appreciate i am in an entirely different position
to what you are, you having personal knowledge of the facts entirely indepen-
dent of the record and the fact that as far as I am concerned I must be
satisfied as to the files and can only be by proper abstracts of records snow-
ing such titles. Iou may find it necessary to write to the Land Department
at washington in order to insert in the abstracts proper references to the
way title has passed out of the United states Government.

Kr./hittier has suggested with the abstracts that i am returning
that i send you a map showing tie surveys which they have marked in red pencil
indicating the different surveys and WthL they think will facilitate tie
putting of the abstracts into satisfdctory shape. Please return this map after
it shall have served your purpose. Please be goou enough to put yourselves
in my position here in Chicago and you will understand why it is necessary for
me to insist upon the observance of the requirements that I am making as to
these titles.

On my return from Georgia I had a confer-
ence with Mr. Kraft and he had just finished reading
the court opinion that you cited regarding the land
titles. This opinion seemed to, in a measure, clear up
his mind. If you have any decisions on the subject I
wish you would send them to him, as I feel now that
he will be able to pass titles.
Will you please write him a letter stating
that the taxes on the coal fee is paid up to éfiifia l,
1925. I am going to make him an affidavit that the
Kentucky Beaver Colleries has been in peaceful possession
of the property at all times since signing the lease,
and also forward him the tax receipts.
He told me that you did not send the
abstracts and maps back to him. If this has been overlooked
please send them back, because I am in great haste to have
his Opinion so that I can begin some actual work.
