LEXINGTON & EASTERN
RAILWAY COMPANY, DEFENDANT.S

The plaintiff, James Smallwood, for his cause of action
herein states that the defendants, Lexington & Eastern Railway
Company and the Louisville & Nashville Railroad Company, are
each<;orporations, created and existing under and by authority
of the laws of the State of hentucky, with power to sue and
be sued, and to contract and be contracted with and the defendant,
Lexington d Eastern Railway Company's line of railroad passes
through Perry County.

He states that on the 20th day of August, 1915, he
delivered to the said defendants at Appalachee, Virginia, for
shipment to thoberts, Kentucky, 3 bill of household goods and
wearing apparel, and that the said defendants promised and agreed
to safely tranSport same to the said place of consignment, and
deliver the same to the plaintiff; that the said defendants
were at that time and have been ever since said date, common
carriers for hire, and that the charges on the said bill of goods
was n9.69, and that the sad amount was paid to them by this
plaintiff for the safe shipment of the said goods; that at the
time the Said goods were shipped the said defendants gave to him
a written bill showing the dates of the said shipment and the goods
which were shipped and since that said time the said freight bill
has been lost, and cannot now be filed as part of this pleading,
but the plaintiff says that the defendants now have in their
possession a copy of said bill.

He states that the said goods consisted of household
goods and wearing apparel, that a portion thereof was packed in
a trunk and some in a box, that the defendants negligently and
carelessly kept the said goods on the road from Appalachee to
thoberts from the said 20th day of August, 1913, until the 10th
day of October, 1915, and that when same was finally delivered
to this plaintiff the said goods which were packed in said trunk
and box were molded and ruined and of no further use to this
plaintiff.

He states that there was in the said trunk three new
quilts and that they were worth the sum of $5.00 each, that the
said Quilts were damaged in the sum of $7.50, and that there was
a suit in the said trunk and that same was totally worthless to

“ plaintiff, and that same was reasonably worth the sum of $10.00
that there were 11 qrilts in the box and that they were damaged
p20.00 or more; six pillows worth $12.00 and that they were
damaged at least d5.oo; that there was shipped with the said
goods one set of Springs worth the sum of p6.25, and that the said
springs were lost by the said defendants and never delivered to
this plaintiff.

He States that the said defendants did not safely carry
and deliver the said goods, but negligently failed to do so, where—
by the said goods were damaged and lost as aforesaid to the damage
of this plaintiff in the full and just sum of 949.00, with intezea
thereon from the said 20th day of August, 1913.

KEEEEEGRE? the plaintiff prays judgment against the
defendants for the sum of $49.00 with interest thereon from the
20th day of August, 1915, until paid and for his cost herein
expended, he prays for all proper and equitable relief to which
he maybe entitled.
