STATEMENT OF CAUSE OF ACTION ‘
Plaintiff states that on or about 21st day of June, 1914,
he went to a station on the line of the defendant, known as
'Kentucky Jewell Station, same being a station where no tickets
are sold or baggage checked but cash fare is collected to
neighboring or other stations, for the purpose of boarding a
train on defendants‘ railroad to go to hazard. Plaintiff
states that hh intended to and did pay his cash fare from
Kentucky Jewell to Hazard on said train, and that while he
was attempting to board the train and before he had reasonable
time or opportunity to get safely aboard said train that
defendant by gross negligence and carelessness started said
train before he had reasonable time or opportunity to board
same, and the train with an unusual and unnecessary jerk
and unnecessary Speed caused the plaintiff to be thrown between
the platform of the car he was attempting to board and the car
immediately following some, so that his shoulder Was pulled out
muscles of the upper arm and shoulder the ligaments of same
were strained and torn.

The plaintiff, George E. Beuris, states that the
Louisville a Nashville Railroad Company is a corporation or-
ganized and existing under and by virtue of the laws of the
State of Kentucky, with power to contract and be contracted
with, to sue and be sued, to engage in the business of
operating and maintaining a raierad in the state of hentucky,
and elsewhere; and tn;t said Louisville & Nashville Railroad
Company wis on and at the time hereinafter mentioned and
complained of operating a railroad in and through Perry
County, nentucky.

The plaintiff states that on or about the 25d day
of June, 1914, he went to a station on the line of said defendant
in Perry County, Kentucky, known as Kentucky-Jewell Station,
the same being a station where no tickets are sold or baggage
checked but from which cash fare is collected to neighboring
or other stations, for the purpose of boarding a train on Said
lin of railroad to go to hazard in the said County. The
plaintiff states that he intended to and did pay his cash fare
from the said station of Kentucky-Jewell to hazard, Ky., on
the said train. The plaintiff states that on said occasion
while he was attempting to board said train of the defendant
for the purpose of being transported to hazard, :entucky, upon
the cash fare payment as aforesaid, and before he had reasonable

time or reasonable opportunity to get safe 1y aboard said
train, the defendant, by the gross negligence and carelessness
of its servants in charge and Operating the said train in
starting said train before plaintiff had had a reasonable
time or Opportunity to board the s me and in starting the train
with an unusual and unnecessary jerk and at an unusual and
unnecessary Speed, caused this plaintiff to be thrown between
the platform of the car he was attempting to board and the
car immediately foilowing same, so that his shoulderwas pulled
out of place and the muscles of the upper arm and shoulder and
the ligaments of same were strained and torn, from which said
injuries, which he avers are permanent injuries, he has suf-
fered and will continue to suffer great loss of time and money
and by which his earning power is greatly and permanently reduced,
to his great and just damage in the sum of twenty-five hundred
dollars ($2500.00), no part of which has ever been paid.

for the sum of twenty five hundred dollars ($2500.00) together
with his costs in this action expended. He prays for all proper
relief.
