Your letter of August llth enclosing me copy of
Petition in the case of Reeder Holmes vs this Company.
Conductor Bocook who was in charge of the train
advises as follows:

In reply to your file No.4509. Reeder
Holmes boarded train in my charge with Mr.J.N.Watts,
P.O. Ned, Ky. Holmes paid fare to Hazard and Watts
paid fare to Fleming. Just before reaching Hazard
I was passing through train collecting fare and
taking up hat checks and Holmes had removed his check.
I insisted on him giving me the check but he claimed
he had paid to Blackey. I told him if he went beyond
Hazard he had better get him a ticket. I passed on.
After reaching Hazard and doing station work I walked
through train and found Holmes, called on him for a
ticket and he refused to pay. I tried to reason with
him and his friend Mr. Watts told him to pay his fare if
he wanted to go farther. He refused and I put him off
of the train."
" August 24th, 1914.
In reply to your file 4309. J.W.Watts, P.O.
Ned, Ky. was the only person negr me at the time Holmes was
put off. Hlagman E.C.Carpenter came up about this time
Holmes and l were in the conversation but does not remember
what was said."
The Flagman did not know anything concerning the transaction

Lexington a Eastern Railway Dompany Defendant.

The plaintiff, Reader Holmes, for his cause of action
against the defendant, Lexington s nastern Railway Company, says
that the Lexington a Eastern Railway Company is a corporation,
organized and existing under the laws of the stnze of Kcntucny,
and as such, has n right to contract and be contracted with, sue
and be sued, and is engaged in building and operating railroads
and was so enguged.in Perry County, Kentucky, on the 22nd day of
November, l9l5,

Plaintiff says that he, occompunicd by two of his friends,
boarded one of defendunt's ruierud p.ssenger curs, tne destination
of Which Was mcRooerts, LetCner County, Kentucky, at Onavies,
Perry County, Kentucky on Nov. 25, l9l5, and paid his full pus—
suge fare from CflaVlce, Perry County, Kentucky to McRoherts,
Letcuer County, KentucKy, to the Conductor of said our and was
accepted as u passenger on the said our by tne said conductor.

Plaintiff says tnut on upproaching hazard, Perry County,
Kentuchy, the conductor came through the car in which he was
seated and informed him thut his destination was — HAZnRD—
and that on his contention that he nad paid his fare to mcRoherts
the 531; conductor got mud, threatened to put nim off as soon
as they arrived at Hazard.

Plaintiff says tngt on thriving it Hazard the conductor
ordered him off of the ear; that no undertook to prevail with

. him, but in spite of any und ull explunutions and appeals, the
said conductor, the agent and serVunt of the defendant, took

Plaintiff says tnat tue expulsion from defendant's
car by its conductor and agent, after he nod polo nis fare and
offerei to pay it again, in file presence of the passengers on
toe our and a crowd of people assembleu at toe depot, at HaZord,
was unlawful, wrong, shameful and numiliuting; tout me was wrong—
gully assaulted and by force ejected from the said car; tout the
unlovful and smomeful acts of one uefendant, its agent, servants
and omployes, nos cauSwd tnis ylaintiif grelt mental anguish and
pain; Coat all of one injuries Herein comyluiHEu of were brought
about ano Caused by toe gross negligence and misconduct of tne
defendant's oganzs an; servants; tout by rouscn of toe wrongs

uged in the sum of Five Tnousand Dollars.

Wherefore fine plaintiff groys Julgment agoinst the de—
fendant for Five Tlouolnd ($5000.00) Dollars, for uis cost and
