Refer to your letter of October 26th, in connection with
suit of John S. Webb V. the Company, in which he claims that the
Railway Company refused to accept ties at Thornton Creek for which
he held contract.
, I hand you herewith letter from our Headmaster quoting
letters from Mr. Moore who was concerned, from which you will note
he states a copy of such contracts were forwarded to the Chief
Engineer of Construction when one was entered into. A copy of
JhiS letter is being sent to Mr. Williams with the request that he
forward to you such a contract if there is one.

Dear Sir:
We have placed with us a claim against the

Louisville & Nashville or “exington & Eastern Railway Co. in
favor of John S. Webb, which i intended to see you about
while you were in town. Mr. “ebb claims that he had an agree-
ment with the construction agent to take all the cross ties
that he could furnish on the railroad rightway. He says that
he has furnished some several hundred tics For which the
agaent or Conpany was to pay him fifty cents per tie. Mr»
Swistman, who is employed by said railroad company, has
notified Mr. Webb not to place any more of the ties on the
rightaway, that he will not pay the price as per agreement.
Mr. Webb has left on his hands 548 of said tics, which he is
ready and willing to place on railroad right-way, as per
contract. The mill which Mr. Webb had employed to saw those
tics has moved away and gone and these tics will be an entire
loss to Mr. Webb, unless they are taken up by your company.

We would like to settle this matter without litiga—
tion, it possible. Please let us hear from you at once.
