Dear Sir:-
* Replying to yours of 20th.with reference to case of DthIson
vs.the company and myself. Shipment in question which Mr.lson alleges
I refused to deliver him consisted of two barrels of sugar and two cases
of salmon,shippers W.HePotter & Co.Kona,Ky.This shipment arrived at
Fleming during night of August I5th.conductor Moore.

Mr.Ison's wagon called for this shipment 10.30 AM August I7th.
but refused to accept the shipment unless I would mark 15 pounds wasted
out of one barre1,I refused to do this as the damage consisted only
of the head of barrel being broken in and a small amount of sugar on the
flour at the most not exceeding two pounds,the barrel at time of delivery
weighed 373 pounds. As I could not prevail upon the driver to accept the
barrel with any reasonable estimate of the damaged noted,I suggested he
would ask MreIson to come up and look at the damage,he agreed to do this
and drove off,as soon as his wagon returned to his storewég went directly
to Whitesburg and had this petition instituted without looking at the
alleged damage. If MI.Ison would have called at the station as any liberal;
minded man would have done this unnecessary expense would not have been
created,it was purely done to satisfy his desire to be in the lime-light
and gain the cheap notoriety as it would offer,he absolutelyghas no case
at all,he has seen fit td discharge his driver over it. (iv?

Dear sir:
I have just returned from Whitesburg where I have
been practically all this week, looking after various matters
and especially cases pending in the Letcner Quarterly Court.
I tried the case of 11.11. Ieon vs. L a E and J.A. one}; Agent.
at Fleming. This action as you will recall, was for claim and
delivery of goods, which Ieon claimed and Shey refused to deH
liver to him. The trial resulted in a verdict for Ison for
$25.00. The facts as proven, are as follows:
mr. Ieon had two shipments of goods. A notion or
dry goods bill was shiyped from Lexington to Fleming. He also
had a shipment of groceries from Kona which included two barrels
of sugar and two cases of salmon. Mr. Ieon sent his man down to
the depot to get these two shipments;.the freight bills were
presented at the depot and the freignts were paid on both ship~
ments to the agent, ur. Shey and Mr. Shey sent a Mr. Kloes who
was Working with him, to the cars on the yard to deliver the
goods and they at first, loaded in the wagon the shipment of

dry goods or notions which conSisted of some brufififidand two or
three boxes of other things and When they came to the grocery
bill, they found one of the barrels of sugar with the head broken
out and a part of the sugar spilled on the car floor; mr. Shey
was called down and he and the man getting the goods for Ison
could not agree on the amount of sugar that should be marked

short and Mr. Shey then declined to deliver any of the goods;
that is, the goods that had already been loaded in the wagon
and especially the dry goods bill until the whole was delivered
and IE. Ison orought an action and obtained claim and delivery
for the goods..0n the trial,of the case, he showed that a cer-
tain amount of the sugar was gone and that he had bought these
goods for the purpose of resale for profit and that he had on
that day, taken several orders from people for the delivery of ‘
sugar and other goods included in the bills and was unable to
fill these orders from his goods, but was forced to buy the
goods from a retail local dealer in order to supply his custom~
ers and claimed damage by reason of the profit lost on the sale
of goods, hence the judgment of $25.00.
I did not get Mr. Shey as a witness, but did have
Mr. Kloss who was working at the time, with NW. Shey. I
