The affiant,Bradley Carnes, states on oath, that on the
day Albert Coply got his leg cut off with the train, near
Neon station on the Lexington & Eastern hailway, that he saw
Della Wade, and another colored lady by the name of Ella, but
he does not remember her other name, and another colored lady
in the town of McRoberts on the morning the accident occurred
that they all got on the evening train leaving McRoberts, the .

~ day the accident occurred, and came down to Neon, that this
affisnt stepped off of the tain as it backed in on the "Y"
he stepped off on the platform of the Davis Hotel, as the
train backed in on the "Y" and left the three colored ladies
on the train, one of which was Della Wade, and the train backd
on in on the "Y" and as it pulled down, going towards the
meter tank and the stop at Neon, he saw the three colored ‘
women on the train, and they did not get off, neither of them
until the man got hurt and the train backed up, after the
accident and then it was that Della got off of the train and
came up to where the man was lying on the ground, and he fur-
thers states, that Dells Wade was not standing on the plat fan
of the Hotel at the time the man was hurt, and that from the
pOSition she was occupying on the train as it pulled out off
of the ”Y", at the time he saw her, she could not have seen
the man at the time he was hurt. fl

we made a hurried trip to McRoherts, or Flemming, and Mr.
Harvie, as he writes you, came over and rendered his asaistane
to Mr. Gilbert, and we have took up some matters here, and got
matters under a fairly good headway, but I do not think there
is anything further right now that can be done along this line
until something further develops, but we have a party working
that will Show up something I feel prety sure, in the near
future, that will be more oeneficial to us. ‘
