Plaintiff says that the defendant, The Lezingtah & Eastern
Railway Company is a corporation organized and existing under and b'
authority of the lave of the state 01 Kentucky, and by said laws author—
ized to construct and maintain gailraod lines and to make contracts
and to sue and be sued in said corrorwte name. That at the time here—
inhﬁter mentioned the said Defendants was engaged in constructing a
line of railroad up the North Fork of the Kentucky River in Breathitt
County, Kentucky, and particularly at or near the Post Ofiice of Bush
Branch.
Plaintiffs say that they are partners doing a general
merchandise and railroad tie business at Bush drancn, Kentucky,
and Were at the time hereineiter stated engaged in said business
in the manufactUiing, sale and delivering or railroad ties. I
That on the Day of March, lClB, the J'Jefendant laid ,
their steel rails on that portion or their railroad line at
and near Bush Branch, thus practically completing the location
and construction or their railroad at said point. That at said time
. the Plaintiff had a contract with the Defendant for the delivering
of iive thousand railroad ties at a point on the right of way i
acceptable to the Defendant; that the only place at which the defen— E
dant would accent said Railroad ties was on the Opposite side E
oi the said Railroad tract from Plaintifi's place oi business. That E
when the defendant had comnleted their road bed and laid their steel ;

the point where they use to deliver same, as to make it imbossible
for them to take ssio ties across said railroad tract. rhat the
said hoadbed and tract not only destroyed a public pass way or
haul road which plaintiiis and various other citizens or said
aountg had used for more then iiitcen (15) years, but so illled
up and obstructed the County road so that plaintiiis were unable
to take said ties us either or said roars across the defendants
roedbed and tracts, and were unable to take said ties across the
said roadbcd and tracts to a noint accepthole to the Jeiendant. Chat
on account of ncfendants acts in rentering it immossible for Vlejn-
tiif to deliver ssid ties that they have been demaned in the sum
of 3100.00

Shut the Lorendant has name no ﬁrovision or arrengmengﬁ
for the ?lainti;is or the public crossing or their railroad
tract on either the public passwar or the county road. That
the obstruction of said read and passway was done without nlaintifrs
consent and against their wishes.

That in addition to said damages the “laintiirs have by

That the plaintiff in attempting to deliver said ties
