I enclose carbon cepies of the depositions taken in the
case of Lee Campbell against the Lexington & Eastern Railway Company.
1 You have copies of the pleadings. You will recall that on motion of
r\fi the defendant we succeeded in having this case transferred to the
53 equity docket. These depositions were taken on September 30th, but
were tranSoribbed about a week since. I was not in position: to begin
taking evidence until I assured these copies. Kindly look over them
carefully and let me have your suggestions with reference to the
matter.
At the time the original trade was made with Mr. Campbell
as I new remember it the right of way was staked out below his house,
possibly the way witnesses testified that it was staked. I walked
around below the house up to the spring with Mr. Campbell. He claimed
that the railroad would destroy his spring, I remarked to him that I
did not believe it would reach the spring by several feet, but in the
settlement I was willing to pay him $50.00 for the spring whether we
took it or not. We agreed upon the value of his improvements, including
his house; we agreed to pay him $5.00 a piece for the trees, none of
which were bearing,and a hundred dollars an acre for the land, the sum
total of which, including $50.00 for the spring made the total
consideration for the deed. He then and there executed a bond for a
title. At the time this bond was executed I paid him $5q,oo gig the

consideration. Some days later I went up to Mr. Nimrod Fugates, a
near neighbor to Mr. Campbell to take conveyance from Fugate, and
while there Campbell and his wife came down and executed the deed.
I paid him $950.00, deducting the $50.00 previously paid and took
the conveyance.
It is going to be very inconvenient, practically impossible
Jifor us to procure evidence and prepare our defense in time for the
p ‘ next court. I wish you would carefully examine these depositions and
5‘ papers and ascertain if we can find some grounds upon which to continue
this case Without filing an affidavit and let me have your answer by
Saturday of this week. (I expeotf to spend Thursday and Friday in
Lexington, returning here Saturday morning).
It occurs to me that in the proper pgeparation of our
defense we should take the depositions 9? Eyeelf and Mr. Sewell and
‘Eof the engineers who constructed the concrete opening to the spring;
and also take the depositions of some good substantial land ownersv
{Res tofthemyalue of the land.4 As I now redollect it this land is not
QSEEt exceeding $46. deego per acre. You will observe that none of
the witnesses for the plaintiff would commit himself as to the value
of the land.
