Dear Sir,

While I was in the court room at Frankfort yesterday,
the Court, by Commissioner Clay, denied an appeal in the
above case and affirmed the judgment for $500 with damages.

I am more and more impressed with the View that it
ought to be only in rare instances that we attempt to get
the Court of Appeals to grant us appeals where the judgments
are under $500.

I am not familiar with the facts of this Reed Thomas
case. But, stating the proposition generally, I think where '
the question is only one of excess of damages and where there
is some evidence to sustain the verdict, and the only argument
we can make on that point is that the verdict is not sus—
tained by sufficient evidence, our policy, generally, should
be to act towards the other side as though we expected to
take an appeal, but not to incur any expense to that end,
and endeavor to bring about a compromise of the judgment
without appealing, and then settle the matter. 1‘“ ,

' Appeals some time in the latter part of March, which recited
that in L & N R Co. v. Cornett a brief was filed with notice:
‘ Yesterday, when I was at Frankfort, was the first
opportunity I have had to run this matter down. I find that
the newspaper report was a misprision and that the case that
was meant to be referred to in the report was L & E Ry. Co.
v. Reed Thomas and Elizabeth Thomas. I suppose this is the

This is an appeal prosecuted by the appellant, Lexington {
& Eastern Railway Company, from a judgment of the Breathitt Circuit
Court rendered at its January Term I915 in favor of the Appellees,
Reed Whomas and Elizabeth Thomas, for the sum of Three hundred
($500.00) Dollars, as permanent damages on account of the
obstruction and diversion of the channel and current of the Rorth
Fork of the Kentucky River by a fill constructed out into the
river at a point on the opposite side of the river just above
. Appellees’ land, by reason of which their river banks and river I
bottom land and fencing has been caused to be washed away and
injured.
The facts of this case briefly, are, that the Appellees',
together with other lands, are the owners of a tract of four acres
of land situated in what is known as the "McIntosh Bend“ of the
North Fork of the river and opposite to the railroad of the

' ' construction of its' railroad the appellant did not follow
this curve of the river, but built its track as nearly straight
fas possible, making ancut and fill in the bend from 20 to 50
feet so that the bed of the railroad isynow almost where the
‘ river ran before the railroad was built; This caused the
Channel of the river to be narrowed and the current which formerly
ran on the side of the river next to the side on which the
railroad is built to be diverted and changed so that the current V
and channel of the river since the construction of said fill
runs on the side next to the appellees' land, end in addition
to this fill, which is from four to five hundred feet in
‘ , length the appellant caused large rocks to be thrown into the
river just below the fill, further diverting the channel and
current of the river against the lands of the appellees,
thereby causing them to wash away as before stated.

relied upon a number of alleged errors claimed to have been
_ ~ committed by the Court in the trial of this cause, but in the
brief of counsel for appellant all of the alleged grounds for
new trial are abandoned , except one, and appellant seeks a
reversal of this cause upon this appeal in the language of its'

counsel "upon the sole ground that the verdict and judgment
, are flagrantly against the weight of the evidence and the
damages awarded grossly excessive."

There were ten witnesses in all who testified upon
. the trial of this case in the lower court, only three of
them testifying in favor of the appellant, while seven
witnesses testified to facts which amply support the verdict
' and judgment rendered in favor of the appellees.
Reed Thomas, one of the appellees testified that the ‘
lands of the appellees lie just below the fill made by the
appellant in the river and on the opposite side from the
> railroad; that the railroad did not follow the curve in the
river just above the appelless' land, but was built straight,
making a cut and fill in the bend so that"the bed of the
railroad is now almost where the river use to be before the
» railroad was built". (Tr. page .'5); that this fill, which was
begun in the year 1910 extends out into the river 20 to 30 .
feet, and that it has changed the current and chattel of the
river; that before the fill has made the current ran on the
side of the river opposite appellees' land, while now it runs
. on the side next to their land. (Tr. page 5); that the
’ diverting of the river from its natural flow caused appellees'

land to break off since the fill was made and caused the soil
to be washed off; that it has so washed out their river banks
4 that appellees cant keep a fence along the river; that this i

of about 200 yards, excepting a little piece at the extreme
' ‘ lower end, and the soil has teen washed off all along the
river front and the banks caused to break off and slip into
' the river, and bushes and trees that formerly held the soil
and kept the banks from washing away have been rooted u; and
’ washed out by the water. (fr. page 5).; that appellees
formerly raised each year about fifty bushess of corn per acre
I on this land; that three acres of the said four acre tract
' are river banks and river bottom lands and ayyellees raised (
each year at :50 bushels of corn on this land, anion was
ordinarily worth One Dollar per bushel, and the average crap
' yield by this land per year amounted to about lne Kindred and
Fifty Dollars; that this three acres of land was worth Two
Kindred and rifty Boilers yer acre before this injury, and
that the land has already been impaired in its market value
’ ‘ by reaSOn of the washing aforesaid in the sum of 7500.00.

above his land is 463 feet 1035 and that just lelow the fill
appellant threw large rocks into the river nearly opposite the

Anderson ahitaker,the next witness introduced for
Appelleee testified that the fill extends out into the river
30 to 35 feet and is from four hundred to five hundred feet in
length, and that large reeks were blown out into the river just
below the fill, (fr. page 2163 that the current ran on the side
. next to the railroad before the fill was made but new on account
of the fill and the rocks thrown into the river the channel and ‘
current runs on to the side next to espellees' land: and have
, caused the banks to be washed out under the fence and the poets
left hanging on wire off of the ground, and that the soil has
been washed from one end to the other, {Tr. page 23).

river banks and has caused large slips in the bank, whereby
' the vendible value of this land has been diminished 400.00;
that this land formerly raised from fifty to seventy—five
dollars worth of corn an acre per year and was worth $200.00
an acre before the construction of the fill and the consequent
I washing away of the soil, (ii.‘r.54 to 55); that witness; has been
acquainted with this land for a number of years, and that there
were never slips in the banks before the fill was built by the a
. railroad, (Tr. page 65).
Ed Combs also introduced by the appellant testified
that the fill changed the current of the river to the Thomas
side and caused the soil to be cut off and trees washed out,
whereby the vendible value of the land was redueed from $500.00
to 5500.00.
: The appellant introduced Richard Bowling, 3. E. Strong
‘ l and Elisha Haddix, each of whom undertook to testify that the t
’ - current of the stream had not been diferted by the fill, and
that the vendible value of appellees' Land had not been injured,
I but two of these witnesses, D. P. ttrOng and Elisha fiaddix,
I each admitted that they had not been on the Thomas side of the
river since the construction of the fill, and that their
_ observation had been made from the railroad side of the river
while riding along on the railroad trains, and that their
testimony was based upon such observation from the Opposite
