was injured was one of a number of cars loaded with ties then i
standing upon the switch mentioned in the petition which is in £
the country retmte from any tewn er station, and is used only i
for loading ties; that said switch is upon the south side of the I
defendant's main track with which it is connected at its west 7
end, the east end at“ the st'ritch being: open; that said ties were
' all for shipment to the West and could snly be taken out in west ;
henna ears, and that in order fer a west bound train to get the V
cars that were nyon said switch, it was and is necessary for it

ordinary care te leek out for said train in waking said enuyling
in order that he might net be injured by the jolt which necessa—
rily occurs when a freifiht train coupling is 'ade, but says that
the ylmintiff upon eaie occasion was negligent in this, than he
negligently continued to stand uyon said ear and negligently :
placed and kegt himeelf in a position where he might be injured j
by the contact of the ears in making said oouplifig and negligently

of injury ooxwlained of in the petition his employer was having
loaded on to some ears on a side track of the defendant, cross
ties, which ears had been placed there to be so loaded by his
employer and employee for the yurpose ~~‘i‘ being earried over
defendant’s road by defendant and ylaintiff was upon one of said
standing ears engaged in work and had a right to me there and
while at said work, defendant negligently backed a train into
said standing ears and knocked the plaintiff therefrom and ianred
him as stated in the petition.
WHEREFORE, he trays as in his petition and far all proper
relief. '
