On September 15th I wrote you as follows:-
"Please note papers having bearing on bankruptcy of
C.E.Cutshaw.

On July 13th C.E.0utshaw was attached through the
court of H.H.Bolinger, Hazard, Ky., by John Elliott for $29.00 and
on August 12th. through the court of Judge J. W. Stevenson at
Winchester by Levi & Herman for $70.88.

We have answered the court for the total amount of
the attachment. So far no rule has been received from them.
ghere is due Cutshaw for June $169.61 and for July $203.95,total
$573.56.

Will you kindly advise what action we should take in
View of thee ttachmentsthat has been answered."

' To which you replied under date of September 1th
as follows:-

"Replying to your communication of the 15th inst.
and returning herewith the papers attached to your letter in ref-
erence to the bankruptcy and attachment proceedings affecting
0. E. Cutshaw, I have to advise as follows;-

The letter of Harvey T. Lisle, the trustee in Bank-
ruptcy of C. E. Cutshaw, indicates that he was appointed trustee
on September 4th. Under the bankruptcy law, all attachments,&c,
instituted within four months before the bankruptcy proceeding, are
supersuded by the procedings in bankruptcy. Accordingly, I suggest
that you make report to Mr. Lisle, as trustee in Bankruptcy, of
the amounts due Cutshaw for the months of June, July, August, and
September, and the disposal which you may have made or undertaken
to make of his wagers in obedience to-any oneymore of the several
attachments, indic:ting the amount covered by each attachment and
the court in which pending.

_ . At the same time I think you should address a Commun-
ication of Squire Bolinger at Hazard, in the suit of John Eliott
against gutshaw, explaining that the Company is unable to answ r
as §uarn1shee tor the reason that bankruptcy roceedings have geen
ins 1tueed, and all moneys due cutshaw are eld by the Company

subject to disposal by the trustee in bankruptcy.

' At the same time I think you should address a similar
communication to Judge J. M. Stevenson at Winchester, modifying
or retracting the answer you have heretofore made in his court
as garnishee in the suit of Levi & Herman vs. Cutshaw, explaining
to him that since you-made reSponse to theattachment issued by him
or from his court the bankruptcy proceedings have been institued,
and under the law the Company is now is now required to hold all
moneys subject to the order and diSposal of the United States court
and its trustee in bankruptcy. I think you can make the answers as
above outlinged, but if you perfer, I will undertake to prepare
them for you."

Acting on the third and fourth paragraph of your letter
I advised Mr. W. H. Bollinger, Hazard, Ky., and Judge J. M. Steven-
son of Winchester Ky, in accordance therewith, that we would be
unable to make payment on account of bankruptcy proceedings.

I requested to Mr. Jouett, at Winchester on October
11th to protect the Companys' interest by handling and he advised
on October 14th as follows:—

"I am in receipt of yours of the 11th relative to the
above enclosing red ticket for $289.0fiL but I do not fully under—
stand it. In this ticket you state.

The amount of this ticket represents $29.00

answered court of W.H.Bolinger, Hazard, Kentucky.,Att.
John Elliott, and $70.88 court of J.M.Stevenson,Winches-
. ter,Ky., att. Levi & Herman, and balance due C.E.Cutshaw
on June and July 1915 pay—rolls as carperter foreman. -
~ This payment made proceedings from Mr. A. R. Burnam Jr.,
referee in Bankruptcy, Eastern District U.S.Court.
In your letter you state-
I notified both of the above named courts under
date of Sept. 21st. that we would be unable to make pay-
ment in thea.ttach ents on account of the bankruptcy pro-
ceedings.

I know that the $70.88 has been paid into Jud e

presume the $29.00 has been paid at Hazard. I am a little confused
as to whether the $289Jfl21®presents the balance due Cutshaw after
the $29.00 and $70.88 have been deducted, or whether it includes
those two amounts. By reason of the statement in ygur letter of
the 11th, I an inclined to the belief that you are including those
amounts in this red ticket, and if that is correct, it must be error,
as I know the $70.88 has heretofore been paid.

I am herewith returning you the red ticket, and will ask
you to advise me whether it is correct, and whether it includes the
amounts heretofore attached. Id 0 not thingk you can pay any at—
tached money to the trustee in bankruptcy without an order having been
made in the attachment proceedings to that effect and showing that
the trustee has a prior claim to the attached funds."

I was never able to get a reply as to whether the attach-
ment of Levi & Herman Vs. C. E. Cutshaw was a duplicate of one ser—
ved prior and for the same amount. ‘

The red ticket herewith represents the total amount the
Company is indebted to Cutchaw, including the $29.00 and $70.88 an-
swered to the court at Hazard and at Winchester respectfully. The
first attachment for $70.88 is a separate transaction and has no
bearing on the one now referred to by Mr. Jouett.

Acting on your letter of September 15th I forwarded the

1 total amount as per the red ticket to Mr. Jouett for disposition.
Will you kindly advise Mr. Jouett and this office whose position is
correct, that is, whether we are at liberty to pay the trustee in
bankruptcy or whether we are amenable to the inferior courts on

P/S. To make the matter of theattachment of Levi & Herman clear
I will say that Cutshaw was att ched by them through Judge Stevensons'
court on July 15th, for $70.88, debt and cost, which we paid in
on order July Elst. Cutsahw was again attached by them, through
Judge Stevensons' court on august 12th, we made answer on August
14th, that we were halding $70.88 and in which question was asked,
"Is this not a duplicate case?" Mr. Juuett had a copy of our answer
and to which no reply, as before stated, was made bx any—one, nor
have we paid into the court or Judge Stevenson the $70.88 left answer-
ed as of August 14th.

The letter of Harvey T. Lisle. the trustee
in Bankruptcy of C. W. Cutshew, indicates that he was
appointed trustee on Septerber 4th. Under the benkrupt~
5y law. all attachments, &c.. instituted within four
. months before the bankruptcy proceeding. are superseded
by the proceedings in bankruptcy. Accordingly, I eug-
geet that you more report to Kr. Lisle. as trustee in
Bankruptcy, of the amounts due Cutehnw for the months
of June. July. Auguet and September. and the disposal
which you may have made or undertaken to make of his
wages in obedience to hny one or more of the acveral at-
tachments, indicating the amount covered by each attach-
Ment and the court in which yending.

modifying or retracting the answer you have heretofore
made in his court as Guerniehee in the suit of Levi &
Herman v. Cutshaw, explaining to him that since you made
reeponee to the attachment ieeued by him or from his court
the bankruptcy proceedingc hive been instituted. and
under the law the Connery is now required to hold all
moneys subject to the order and disposal oi the United
States cour-L and its Trustee in bankruptcy. I think you
can make the emceere us above outlined, but if you pre-

On July 13th. C. E. Cutshaw was attached
throughthe court of W. H. Bolinger, Hazard, Ky., by Jghn Elliot
for $29.00 and on August 12th. through the court of Judge J.g§i
Stevenson at Winchester by Levi 8c Hermn for $70.88.

We have answered the court for the total amount
of the attachment. So far no rule has been received from them.
There is due Cutshaw for June $169.61 and for July $205.95, total
$575.56.

Will you kindly advise what action we should take
