Dear Sir,

I note your letter of July 9th relative to the
W.E.Napier claim, ~ Lexington & Eastern Extension.

I had an extended conference with Mr.Tolbert Holliday
on yesterday and advised him that I would close with the party
on the basis of the attentative agreement that he had reached with
him, - that is to say I would pay Mr.Napier $150.00 for all claims
for damage arising out of the incident referred to.

When you receive the file of correspondence that you
have written.Mr.Holliday for, I Should be glad if you would ex—
amine the same and then send to my Office. Though the matter is
closed, yet I should be glad to have an expression of your opinion
as to the reasonableness of the adjustment agreed upon

You; truly, «
Chief Eng'r.of Construction.

Yours of June 30th. tOVether with correspondence
relative to olaic of W. E. Napier for alleged loss of '
lame at Bridge #3, North Fork thorsicv o? the thirytor
& Eastern Railway .reooivod. I took the wetter up tOday
with Mr. Nanier at Krypton and I fird that he is anxious
to get the matter settled and prefers settlerent be made
Without goiv: irto Court. He said he had waifoi atont

‘ One year on the Corpary, honinr that they NO'li pay him

foe the logs” but so far they hafihnot done so and he was
just arranging to have suit filed. I told bin that in my
opinion the railroad Company had a perfect right to

‘ so atrnot their false work across the river in building
their railroad brifigee and that it richt be poseihle, aftor
a "mine litigation in the Courts, be world be Wgfl to
'pay the cost of the actiOn, and even if he ween't, that paying
his attorneys_and expenses 0‘ fighting the case WOVLd be no
small amount and I advised him to make me a fair proposition
that the matter could be settled now. At first, he oortended
for full amount of hia.olaim, with interest, but after reasoning
the matter with hiw for quite a While he agreed with me

 .
O
that ho onght to stand for at leaat a part of the 1053.
d. C. Rapier, an uncle of his who had listened to our
conversation, asked me thot amount of mo“ey the Company
- flee wil?lmp to pay his nephew. I inovrol hi" that I did

Lathnew but l K43 out; they L.£C wilan, to lo right iv
the matter and that if Ir. Klpier Wool; take me a
reasonable prcgositicn l was of to; CLLELQL the Connery
would accept it a: it would save than from litigation.
Ur. Napier finally mews a proposition to settle in full
99 to his claim for lees 0? love and exp~niee for §”00.00
and 1 still insisted that $900.00 was too much, then his
uncle asked me if I would recomrend that he be paid §1fi0.00.
I told him I wouli submit thnt proposition and in my opirion
the Company would pay it, Or at least give it consideration.
If this is acceptable,l would advise thatthe matter he

‘ attended to at once as tr. Napier will file suit within
the next fifteen days in my opinion if the matter is not
settled. R. C. Napier is a very influential man in this
section and seemed to take great interest in wettingtis nepbfie
to accept this amount and settle out of Govrt.

Yours respectfully, '
