Herewith I enclose to you all papers in connection with the above
Case. You will note that concerning tho"accident a statenent is
only inclosed from McKnight and the Foreman G. W. Patton." David
Patton shoWn as a witness in this Case and living at Gleen but I
learned from G. W. patton that he was some where on the u: river
and that David Patton is now a river man. Ed Adams Jackson was
said to be Working on the extension at some point as section man
and the agent at Torrent wired me that he could not advise me as to
the whereabouts of Brwck Hobbs. “ No one saw the accident at the time
that it occurred and the statement of McKnight at the tune that it
occurred to the Foreman agrees with what he told me and I see in:
no reason for running all ofer the country to try to find these peeple.

McKnight is 26 years old. He lives at Corner Shoal, Leslie County.
At the time of the accident he had been working on the section or“extra
gang about tWo months. On the night of the accident the gang under
the assistant foreman David Patton were Working with some drift that
was against a bridge Just south of Krypton. thnight was sent to
get a deck and it returning with it he fell over a stake, center stake
in the trackand fell. It was a“dark light and he makes the complaint
that he~Was furnished with no lantern. -Hc says that the Foreman called
Dr. Young to treet him ~nd that Dr. Young treated him only once and
then tOld him that he would need no further attention. About two
inches of skin was knocked off of the front pert of this man's log
and on account of neglect his leg is now in very bad condition. i had
him show it to me. There is on flesh on the front part of the bone
from about four inches below the knee until about the shoe top and it
looks very much to me like a sore that would break out on a person.
Right above where the first flesh is gone there is a slight scar which
looks very much like a scar left from a lanced boil. His log is
certainly in a very bad condition.

Dr. Ray and Dr. Collins Who examined this boy for the purpoSo of
testifying as to his condition are first class doctors and first class
men in that section of the country. “Our attorney Jesse Morgan of Hazzard
stone at Dr Rays when he is in Hydcn. These men both told me that

1 they did not like to give their deposition infithis case or get mixed up
in it but that it was on the request of Attorney Calvert, their fellow
toWnsman and the dictors consulted each other before they consented to

make the examination. These doctors are very close friends and practice
together. Dr Ray runs a drug store at Hyden_ I spent Saturday night
with him and I believe that the doctors are telling me the truth of the
matter - the leg is there for itself to Show and the only doubt in my
mind Was how come it to be so bad - it looks very much like syphilis.

You will note that Dr. Young treated this man once and then the
injury was neglected, it is claimed on the advice of Young but it was
also neglected until Drs. Bay and Collins made the examination in Februa:
and in my opinion since that time it has also been neglected. Drs. Ray
and Young perscribed a wash for the leg and furnished the necessary
powders and dressing for this boy to keep it dressed. He lives about
14 miles from Hyden and I suppose that they would make the Contention
the boy could not afford the services of a physician from Hyden.

Dr. Young who treated this boy is nowlocated at Hazzard, KY. He
has never attended a medical school. His father Dr. Young of Bath
County was quite a successful doctor in that territory; Young Dr.
Young told me that he reamined With his father and assisted him in
every way possible until his father died in 1906 at which time the
young man went to Hazzard and located there as an eye specialist.

He worked through the mountains fittng glasses and treating the eyes
up until the tracklaying startei'on the L & E at which time he
started-in as surgeon for the gangs and fifty cents Was deducted from
each man's wages to pay the doctor. This continued as long as the
track laying gangs were out. However at the time of this accident

to McKnight Young was not surgeonfor that particular gang: ,patton

had left the track laying gang and was then in the maintenance or
repair department. McKnight says that Patton called Young. Young
don't know who called him and Patton says he does notknow Who called
him but that he did not. “ Patton says that he paid Young and the
KcKnight repaid“him. Young says that McKnight borrowed a dollar from r
a fellow workman and paid him. McKnight says that the railroad company
paid Young.

We are certainly not liable for the accident but in my opinion We
Would be held liable forrthe failure to give the prOper medical attention
or rather call incompetent medical attention The boy has a frightfiul
looking leg and we should get rid of the case.

While at Hyden I ran on Calvert and I got him down to $300. Without
making him an offer. He is a pretty good lawyer in that part of the
country and a very agreeable fellow. I discussed no facts with him

other than to listen to what he had to say about them and tell him that
Ioould successfully controdict everything that he said that he could
prove. " I hulled him pretty much and I doubt if he Will Come muCh
lower thanr$300., but when I Write him hoW long he Will have to do With-
out the money, when his client needs it for medical attention, etc. .
he may drOp one hundred.
I recommend that authority be given me to settle this case at
not exceeding in $250.

There is absmlutely nothing in the supposition that this man was

injured in theramy. I rode all over the country around his home and
he has not been missing from him home onlyfor a very short time when
he was in the west and no one knew of his having been injured.

MY name is a. w. patton. I was formerly extra gang formcnan
on the L & E R R worth ForkExtonsion. I carried thin man an my time
book as Chester McKnight. Some neopie called him Art McKnight. “ This
man had been Working for me something like a couple of months when he
Was injured; The first that I knew about this man having bwen hurt
was the next day about noon. I was not with the gang with which he
was working at the time he was hurt. I had my gang d1v1ded the night
that this man was hurt. David Patton my assistant foreman was in i
charge of the gang that thisman Was with.‘ McKnight thld me that he “
Was working at the trestle and that he went after a Jack and fell down 1
with the Jack and hurthimserf. This manhad a out about one inch and
one half across the shin bone. This man layed up in my camp fbr more
than a month. He than Worked about three or four months for me after
that. I believe that Dr. Young treated this man and also Dr. Hurst
nho lived near TYpO. I do not know whether this man called the
doctor or someone else did. I did not call the doctor. I paid the
doctor for treating this man for him and he then paid me bacx my money.
At the time that the accident occurred Dr. Young was not assigned as
doctor for my crew. He had bnwnbeforo that but was not at that time.

All papers with reference to personal injury
claim of Chester chnight, out of which grows the case of Chester
mcfinight vs. I. l E. H. 7. Co. are handed you herewith. It will
be necessary to have a thorough investigation made of this matter
not only as to the facts surrounding the accident but as to the
present physical condition of thnight, and as to the probable
cause of that condition. Note cepy of Wootten a horgan's letter
to fir. Wilson, dated March 12, 1913 and COpy of deposition of
Dr. W. E- Bay and 3. L. Collins.

Will you kindly refer these papers either to Er.
Gardner or Tr. Landrum with instructions to make a thorough investi—
gation of the matter. You are, of course, familiar with the
rule of law holding Where a railroad company exercises ordinary
care in the selection of its servants it is not liable for claims
growing out of said surgeon‘s lack of skill in treatment of
patients sent to him by the Railroad Company. I do not know

- anything about Dr. Young do not even know that he is surgeon
for the L. g. E. This point shoulh be investigated and we should

 also learn what we can as to his skill and ability in his
profession.
