Comes the plaintiff, Will James, and by leave of
Court, amends his original petition herein, and for amendment
says, that through mistake and by inadvertenee, his Attorney, G.F. Wyeoff,
in preparing his original petition herein, used the name "Lexington &
Eastern Railroad Company", a number of times in the caption and body
of the said petition When as a matter of fact, the name ”Lexington &
Eastern Railway Company", should have been used, as was intended and
that the said Lexington & Eastern Railway Company is the real defendant
in this action. He says that the word "railway" should be inserted and
substituted, for the word of "railroad" throughout the said petition
as was originally intended by plaintiff and his Attorney.

fiHWREFOE? plaintiff prays, as in his original petition,
that his said petition be reformed and corrected, consistent herewith,
that a summons issue on this his amended petition and original petition
as reformed and corrected, for his cost herein expended and for all

have been answered sooner but in some way it became misplaced
on my desk.

I believe in this case that a motion to quash would
not reach it as we must net up in some sort of fleadirj the
correct name of the company. It is not like the ordinary mo—
tion to quash the process. The Code provides that we can on-
1y do this by setting up and giving the correct name.

Now comes the Lexington & Eastern Railway Company and,
without entering its appearance to this action, and without admit
ting the jurisdiction of this court, of the Lexington & Eastern
Railway Company in same, or the subject matter of same, and with—
out pleading to the merits of this action, but solely by way of
plea in abatement says that there is no such corporation, known to
it, as the "Lexington & Easter; Railroad Company”. It says that
the Lexington & Eastern Railway Company is a corporation created
under and pursuant to the laws of Kentucky, with its princigal
office at Lexington,Kentucky; that Arthur Cary is its President
and Chief Officer and resides in Lexington,Kentucky, and that its
true and corporate name is the "Lexington & Eastern Railway Com~
pany", and not the "Lexington & Eastern Railroad Company." It
says that process in the action of "Will James v. 'Lexington &
Eastern Railroad Company" has been executed upon the agent of the
"Lexington & Eastern Railway Company" in Winchester, Kentucky, and
the return on same reads as follows:—

Dear Sir:-

I have heretofore sent you a cOpy of the petition
in the above case. You will notice that James has sued the
Lexington a Eastern Railroad Co., when our corporate name is
the hexington & Eastern Railway Co.

The process was issued against the L. & E. Rwy. Co.
and eyeeuted upon Hr. Puckett, and the return readflas shown in
the plea whioh I ma herewith handing you. Under this state of
case I do not think we should stand by and fail to answer and
let judgment go against the L. & E. Railroad Go.

You might examine the case of University of Louis—
ville v. Hammock, 160 S. Va 218, also the case of Heckman's adm.
v. L. & N. 4 S. N' 542. You will notice in the last case that
our Court of Appeals quoted iron First National Bank of Baltintre
v. Jaggers as follows:—

"There is no doubt that when a party is sued by

the wrong name, and he appears to the suit, and does
not plead the misnomer in abatement, and judgment is
rendered against him in the erroneous name, execution
may be issued upon it in that name, and levied upon
the property and effects of the real defendant; but
there is some conflict in the decision whether the
same result will follow if he does not appear, and the
judgment is obtained by default. The weight of au—
thority is, however, that this makes no difference;
and if the writ is served on the party intended to be
sued, and he fails to appear and plead in abatement,
and suffers judgment to be obtained by default, he is
concluded, and in all further litigatiuns may be con—
nected with the suit or judgment by prOper averments."

I would also refer you to Thompson on Corporations, Third
Volume, Sections 3188 and 5199, under the heading "A misnomer must
Be Plead In Abatementn"

I believe it will be a little too risky to sit quietly
by and allow judgment to be obtained and then to attempt to set it

aside or enjoin the collection on the ground that the judgment
was against the Lexington & Eastern RailTO‘fi Co. when the proof
will show that the agent ofthe L. & E. Ry. Co. was served with
process anfl that the injury, if any, was occasioned by the L.
&. Ea Ry. Co.

I haveo therefore, thought that the best thing to 60
would he to file a plea in abatement, which I believe will he sus—
tained and will thus take the case over until Septemher. I sue—
pect by that time the plaintiff, who is a negro, will have tired
out or left the country.

If you think we should file this plea in abatement
you can have Mr. Gary swear to it anfi return to he, or you are
at perfect liberty, of course, to make whatever changes you
wish in the matter.

Dear Sir:—

On train No.2, Jan.25rd, at flinchestor, Ky., one colored
man boarded train with ticket to Tallega,dy.,and after I had taken up
and cancelled ticket I found that this man had with higfiambggggtmcon—
taining about 5 or 4 gallons of rhiskey. I told this passenger that
he could not carry the whiskey on thatrain,that he would havg to put
it off. I stopped train about 15 car lengths north of station and
when he got off he asked me for his ticket which I returned to him.
This colored man also had some bottles of whiskey sticking out of
coat pockets; also two pint bottles of boer,whioh he left on train.
There being only two passengers in colored compartment of coach the
other one is a witness to this, who is Jake Gentry, of Indian Fields,

The plaintiff, Will James, states that the defendant,
Lexington 8: E’Zastern Railroad Company, is e. eorporat ion organized,
created. sand eyieting under the laws of the State of Kentucky
and as such corporation has tire right to contract and be contracted
with, to sue and. he oned, under and by its corporate name, "Lex—
ington 3-1‘-1netern Railroad Co."
Plaintiff says that the defendant, Lexington 8: Eastern
' Railroad Co., on the 25rd day of January, 1915, and for 9. long
time prior thereto, and has since said date, Operated and is op—
eixating a line of railroad with trains and cars thereon from
‘i‘anhester, Clark County, Ky” to Tallege, in County,
Kentuolqr, as e. common carrier of naeeengers for hire. That on
said 23rd day of January, 1915, plaintiff pnrehaeed from defendant's
agent at ‘.Hneheeter, Ky. 8. ticket which entitled plaintiff to be
carried as a passenger on defendant's passenger train, which left
:’Iincheeter :1 short time after two o'clock P. M. on said date to
Tallega in County, Ky., and paid said agent the sum of
$31.74 the usual price charged for such tickets.
Plaintiff says that he duly took passage on said train
and that after said train had left Z-‘Vincheeter, Ky. on its way
to Tellega in County, on that date, Jan. 25rd, 1035,
defendant's conductor in a boieteroue, rude and Snenlting manner
tore Open plaintiff's baggage and examined the contents of the

same; that Said conductor charged plaintiff with being drunk; that he
abused, insulted and humiliated plaintiff in the presence of
other passengers on said train; that the said train had then
travelled a distance of several hundred yards from Winchester,
Ky. and that thereupon the said Conductor refused to permit
plaintiff to ride further on said train and 5n a rough and in-
sultfing manner ejected plaintiff from the said train and re—
fused to let plaintiff ride to his destination. Plaintiff
says that at the time he was ejected by defendant's conductor
that he was sitting quietly in his seat; that he Was not drunk
and that his said ejection from the said train Was done by de—

fendant's conductor without oause and for the purpose of injuring

hnd humiliating this plaintiff.

Plaintiff says that he was at the time he was ejected
from defendants train, as aforesaid, a stranger in Winchester;
that he was engaged as a laborer at night at Tallega, Kentucky,
at $2.00 per night; that after his said ejection he was compelled
to walk hack to Vincheeter, Ky., a distance of several hundred
yards, to secure lodging and board for himself until the next
day, whioh cost him $1.50 and was caused to lose one nights work

for which he would haVe received the sum of $2.00; that he was
by reason of the wrongful and unlawful acts of the defendant,
its agents, serVants and employes greatly humiliated, insulted
and mistreated, all to plaintiff's damage in the sum of $500.00.
7WRRRPORE, plaintiff prays for judgment against the
defendant, Lexington & Eastern Railroad Co., fior the sum of
~ Five Hundred Dollars ($500.00), for the further sum of $5.24,
for his costs herein expended, and all other proper relief.
