was noted on the minute Book by the Clerk, each Without waiving
the other. -
0n April 7, 1913, in term time, on Order Book, Ho. 14 page
535 the follow ing order was entered:
The filing by the defendat, lexington & Eastern Railway Company,
on March 8, 1913, out of term time, a written motion asking the
' Court to require the plaintiff to verify his petition herein, and
without waiving said motion filing a general demurrer to plaintiff's
petition herein; and without waiving said motion and said demurrer
filing a motion to strike from plaintiff's petition certain parts
thereof, set out in said motion to strike, is no€?€%2record.

Lexington & Eastern Railway Company, Defendant.

. The plaintiff, David Shoemaker, says that the defendant,

Lexington & Eastern Railway Company, is a corporation, organized,

created and existing under the laws of the State of Kentucky,

with power to sue and be sued, to contract and be contracted with.
I The plaintiff states that on or about February 15th, 1912

he was employed by the defendant, and while in the line if his

duty, working on a hand—car the defendant, its agents, and servants,

superior in authority to plaintiff, wantonly, wilfully and with .

gross negligence and caresessness ran and backed said hand—car

into another car, and permanently injured bin in his legs and

body, and more or less injured him in each and every member of his

body permanently; that said injuries caused him to suffer and

undergo great physical pain and mental anguish and still causes fl

and will continue to cause him to be weak, nervous, and more or

less crippled and his power to labor and earn money permanently

impaired throughout the remainder of his natural life.

Plaintiff says his injuries were due to and caused by the
wantonness, wilfullness and the gross negligence and carelessness
of the defendant, its agents servants, and that he has been
damaged by them in the sum of Ten Thousand Dollars.

_ WHEREFORE, plaintiff prays for judgment against the defendant
for the sum of Ten Thousand Dollars, for his costs and all proper
relief.
