with case of Preston Slone Vs L a E Ry Co., Lee Circuit Court-

of M. L. Rowland, Brakeman, Who is now off on a 90 day leave of absence.

' As to the extent of inJury, I aan only give you hearsay evidence.
Bill Bush of Torrent tells me that Slone was incapacitated for about
five weeks. I have addressed three letters to m. Shirley at Mt.
Sterling, Ky., to get him to Write me as to the extent of injtuoy but
have not heard from him. MY information is that this man had times
broken ribs. '

Ac ord mg to the statement of the Engineer I believe the case will
go to the jury. I did not have a chance to get the engineer to sign this
statement. ‘

McDaniels has ogfered to accept $300. in settlement of this case-
There is no court at eattyville until April and I have been impacting
him to drop some more. I have only offered him $50. in this case, The
next time that I see him I Will endeavOr to Close it up With him on a
basis of $150. or less.

3.914, in regard to accident to Preston Slone.
MY name is J. B: Hoskins. I live at Lexin gton, Ky. I was-
Engineer in charge of train running north bound that struck Preston Slone
Just north of the north switch ”at Torrent, After passing the station-at
Torrent and getting on the main line'straight track I saw a man sitting
on the foreman's‘side of the track on the ends of the ties and looked like
he was workingon a bolt in the rail, I was about 20 rail lengths from
him and Was running about 25 miles per hour. Right after I saw him I
whistled to him tongs: call his attention to our train, I whistled‘
road crossing signal to him then, He did not moVe or 1'Ook up and when
_ in about 10 rail lengths of him I applied the brakes in emergency but
the train did not stop until "he was struck, I applied the brakes just
as Soon as I saw that he was not going to get off of the track at the
soundblf'the whistle. He was sitting there on the ends of the ties
looking north or rather withhiis head to the north and looking at what
I thought the rail or with a bol t in the fish plate. He did not look
up or move to my knowledge. ‘The train ran about 13 or 14 carnengths
after I apbl‘ied the brakes in emergency, Agpro aching 'iorrent that day
after getting out of‘the tunnel I blewr for the station and answered a
highball signal, then blew for the board and anSWered it by two short"
blasts of the wnl stle. I do not knot.y whether or not the bell Was mlngirg
' on the engine all f the time» It was passing the station and I-did not ~-
' shut it off. The fireman may have shut it off. This man made no statement
in. my presence.

my none is w. c. Mallory. I an 29 Years old' I live at
Jackson, Ky. I was Conductor on a north bound In freight train,
I think, No. 24 When man was struck at Torrent, Ky. The accident
happened about ‘50 yards north of the denot. The first that I knew
of any trouble Was when the brakes were applied and the train Come to
a stop. I found this may laying out on the side ofthe track, onthe
west side of the track. I pulled my caboose down by him, picked him up,
carried him back up to the station and turned him over to a doctor that
was there. The man was laying about four or five car lengths from the
engine- I asked this man that was injured how came him on the track
there and he said that he was just sitting down there. I asked him hoW
_ bad he was hurt and he said that he was not hurt bad that he had been
hurt worse than that a many of a time- I Would judge that this man had
beendrinking. When the brakes Were first applied we were making about
10 miles per hour. When the brakes were first applied they were not
applied in“ emergency. When the brakes were first applied a servicabl‘e
application was made- That Was something like 10 pounds of air draWn
off. The next application was made right Soon after the first one-
The second application was the emergency. "We had 9 or 10 cars in the
train- After getting mm through the tunnel at horrent the signal
was sounded for the board, four short blasts, and after the board was
given it Was answered with two short blasts of the Whistle. Those were
the only Whi stle signals Sounded after getting through the tunnel up until
the engine passed the station. Alarm signal Was then sounded. I believe
that the al arm signal was sounded before any application of the brake Was
made- The alarm signal and the application of the brake followed one
another right along. I think the engine bell Was ringing- I Would not
say positive about this— n. I was on the rear end of the train and the
train making the noise it is hard to detect whether or not the bell on“
the engine is ringing- People are very often seen passing up and down
the track at the point where this man was struck.

My name is Jr‘fi. Han. I am 35 Years old- I liver'at Lexington,
Ky, 13* 220 LowdenAvenue. I was Fireman With Engineer Ho skins
on north bound frei ght train the day that man was struck by our engine
north of the depot tat-Torrent. Th1 s accident occurred north of the
north switch at Torrent. I had Just gotten up on my seat and I saw this
man about the same time as the engineer, He was sitting on my side of the
track onthe ends of the track and he appeared to be looking in the opposite
direction frOm us- He. was sitting there With his head ducked like he
was working on a bolt on the rail. When I first saw this man he Was
. about 10 car lengths from the engine. Very shortly after that the
engineer b‘ew alarm signal at him and When that was done he raised his
hand as if to highbail us. We then thought that he was going to get off.
After this man dI‘Opped his head back doWn the brakes were applied in
emergency and engine reversed. That Was everything. that could have been
done to have stepped the train. The engine ran about two car lengths
after it struck him. We were running about 15 or 18 miles per hour when
we first saw this man xxmm We had nine cars in our train. A11 loads-
Appl‘o aching the depot at Torrent the engineer Whistlei for the board ad
it was giVen to him and he answered. it by two short b1 sets of the Whistle.
_ He b1 ew for the signal with four short blasts of the Whistle. We blow
, station signal at Torrent before going through the tunnel. I dd not
near the injured man say anyting as to how the accident occurred or how
come him to be on the track,

MY name is Geo. Laughlin. I am 22 years old . I MW? at
794. north Limestone Street, Lexington. I was head brakeman on
north bound freight train that struck man nevr Torrent, Ky; At the
time of the accident I was riding on the fireman's side of the engine.
When I first sai‘: this man he was sitting on the ends of the ties on ti e
left hand side of the track like he was putting in bolts infishniate
and looked like he was Working, The engine was something like 19 or 15
car lengths from him when I first saw him, The engineen was blow ing the
alarm signal before I saw the man on the track. As soonas the Engineer
saw that the man Was not going to get off he applied the brakes The
engine was in about three car lengths from the man when he applied the
brace. He had been whi stling all along there. The train ran about
sex i car lengths beyond the man. I Went back to the man. This man did at
say anything until we got him to the cabmse. Someone then asked him
how he got hurt and he said that he had been hurt mamr a time. He also
said that he did not want to go to Lexington and asked that hebe taken
home. That was about all that he said. After passing through the
tunnel the Engineer b1 ev for the board, four short blasts of the whistle
and answered it'by two short blastsand then after passing the depot he
blew at this man as above described. This accident happened beyond the
switch about 4 or 5 car lengths, When this man was first d1s00vered we
were making about 135 mil as per hour.

Preston Slone v. L. & E. R. Co.,

You will recall that the petition in the above
case was recently filed at Beattyville by heDaniels. You have
heretofore seen the papers relative to the accident in which Slone
was injured and for that reason I am not sending them to you
again. You will redall that no statements were taken from the
train crew by Mr. Shaft for the reason that he reached the con-
clusion that the 55 reports ought to be sufficient for every
purpose. I do not agree with him about this and I think full
statements should be taken from the engineer and fireman, conductor,
brakeman, baggage master and porter, if the train carried a porter.
I would like also to haye some information with reference to the
nature, extent and probable duration of the injuries sustained by
Slone. While this is a case the Company xiii would probably save
money by settling at $100. or $150. I do not think we ought to
- settle over McDaniel's head, even if a settlement could be brought
about by paying 350?,and then have another suit to defend in the

case of Preston Slone v. L. & E. R. CO., Betcher Circuit Court.

I am now handing you herewith our file No. 75525 cov—
ering the investigation of the accident in which Preston Slone was
injured near Torrent, Ky. on Sept. 27th,l9l$. While Mr. Landrum,
who knowsnmre about the local conditions than I do at the place where
this man was injured, thinks the Company owes a duty of lookout at
the place where this accident occurred, it does not seem to me,from
the describtion of the place which he gives in his letter to Mr.
Warren of October l8th,any duty of lookout was owing Slone at the
point in question. You, too, are familiar with.the situation at
Torrent and will be better able to judge as to this than either
of us. I am handing you herewith carbon cepy of my letter to Mr.
Landrum of this date. As soon as I hear from him with the report
of his supplemental investigation of the pase the papers will be
