_ The Plaintiff, Jeff Spicer, states that the defendant,
Lexington & Eastern Railway Company, is a corporation duly organi—
zed and existing under and by laws of the State of Kentucky, with
power to contract and to be contracted with, to sue and be sued in
its aforesaid corporate name; that its chief office is in the City
of Lexington, Kentucky; that the defendants is the owner of a line
of railway extending through Perry County, Kentucky, from north to .
South, and up and down the North Fork of the KentuckyRiver, and was
the owner thereof and in the possession and operating the same with
passenger, freight cars and work trains running over said line both
north and south at the times hereinafter mentioned and is now the owner
of such railway and operation of the same.

He states that on and prior to the 11th. day of July, 1915, he was
employed and engaged by the defendant as a common laborer who was working
upon said Railway Company's track and road-bed and near the town of
Hazard, in Perry Cou.ty, Kentucky, in what was known as an extra gang
of laborers, and as such laborer he, to—gether with the balance of said
gang, was working on said railroad right-of—way, track and road—bed
and under the control, direction and command of C.T.Spicer, who was the

‘ Foreman placed over him, and in whose charge and under whose orders,

. directions and command this plaintiff and the other members of said
gang were engaged to work, and whose orders, directions and commands it
was their duty under their employment as such laborers to-obey, and
whose orders, directions and commands they were compelled to obey in
order to retain their employment; that while so working under said

Foreman upon defendant's track and road bed near the Town
of Hazard, and just below the mouth of Jesser's Branch, in Perry
County, Kentucky, a freicht or work train consistinw of an
engine and several oars,wrongfully, carelessly anE recklessly
‘bore down upon them at about the rate 0' eirht miles per hour or
. more without tiving any warning of its approach either by whistling
or ringing of the hell; that said trains was within a few yards
of this plaintiff and other members of said gang before
it was discovered by this plaintiff; and that at the time of the
discovery of the said freight or work train it was rapidly
approaching them; that there was setting upon said track upOn
. which said train was running a hand—car which was being used by
this plaintiff and the other members of his gang under the
direction, supervision and command of their said Foreman, and while
said train.was approaching said h hand—car and but for a few yards
V distant from the same their said fioreman ordered, directed and
commandethhan to speedily remove said hand—car from said railroad
track in order to avoid a collision between said tran and said hand-
car; that in obedience to said orders,direoticns and commands
of said Foreman he, tozether with the other three members of said
> gang, did attempt to hurridly remove said hand-car from said track
by hurriedly liftinq it from the said track; that the other three
. members of said gang who attempted to helf lift said car from
said track inobedienc" to the commands of their Foreman were boys
of immature yours andof immature strength, ranging in age from
thirteen to twenty, and noneof whom were able to do a man's work
or able to lift said car, and this was known to the Foreman in
‘ charge of said work and men; and that while this plaintiff and
said boys were attempting to lift said car from said track said

boys throurh their inability to lift and remove the same from
said tract let the weight of said car down upon this plaintiff
and thereby strained this plaintiff's back, hips and body so as
to produce great and permanent injury to him; that but for the
gross nealigence, carelessness and recklessness of his Foreman
aforesaid in workins this plaintiff and said sang on said railroad
tract and road bed where trains were constantly passinq Without
signals to approaching trains, and the careless, negligent and
reckless manner on the part of the engineer and crew in charge
of said approadiins ttrain Without giving signals of their
approach upon this plaintiff and ssig said gang of workmen, and
_ the gross neglisence of said Foreman in leaving said hand—car

t standing upon said gain track where passenger, freight and work
cars‘were continually passinr and running, and the gross ngelisence
of this defendant and its said Foreman in 0rd ring and directing
this plaintiff and said boys to hurriedly remove saii car frow
said track to avoid the collesion with said approaching train,
all Of waich amencies combining and concurring at the same time
tr produce iis injuries, saidinjuries wouli not have been produced
to him-

sufferel sreatly, both physically and mentally, and has been unable
to work since that time, and his injuries were so fireat as that they
permanently disablel him sna greatly lessened his power to earn
money for all the Euntusn future of his life, if indeed, they
have not entirely destroyed his power to earn morey in the future,
that the time lost by him nfixssid by reason of said injuries up

He says that at the time of the injuries complained
of the defendant, Laxington & Eastern Railway Company was engaged
in transporting fin goods, wares, merchandise and other freight,
and passengers from Berry Count’ and Letcher County, Kentucky,
over said track at said place to other States and territories
of the Union, and also engaged in transporting similar freizht
from the other States and territorcs of the Union over said
railroad track into Perry County,Kentucky, and points beyond
the place of injury, and the plaintiff was engaged in the
repairing of said railroad traotk at said place at the time of
his said injury-
Wherefore, he prays for jud"ment aqainst the defendant,
