There is hailing I o;n suggest in regard to
fihis case, or any sinila: case that nay be pending in
Perry County. It seems that, in thiu case, the jury
believed the testimony of’tho plainiiff and his rit—
uossos, ulthough nu: witness testifiwd ihat he got only
a very few files. Of course Ir. Blair ought not to have
got the tics without yaying :0: them. He ought to have
paid for ihom Thou ho got them, or had some understand—
ing with Goruott. But even if he did not do that,thc:o
slould not have been a recovery for any greaio: sum than
an amount representing the total value of the ties actu—

This cause came on for trial, both parties
announcing ready, the jury was impanelled and sworn. ;he
plaintiff by his attorney then stated the case, and the

' case was stated by counsel for deiendent. rhe plaintiff,
then introduced in his behalf the following witness:

A. Ees sir.

Q. there do you live?

A. Cornettsville.

Q. :ell the jury whether or not you lost any ties last
fall, and if so about when.

A. I think it was some time last October, October 191;.

L. how many?-

A. I don‘t }nOW'the number myself. i had some hired hands
to haul them out for me, and they gave me the nunmer that
they hauled, and stacked up. when I went over there along

. this spring and passed along and saw that they had gone
away, and I went up and asked Joel :ratt about it and he
said that they were taken away by J-L-Llair, all EUt tWO
and newis nayes took them and paid for them. rhere were
26 ties at first and then heyes took two and left 24, and
then the 24 were taken away by J. i. hlair for the L. a h.
people.

Q. What position did he hold?

A. Extra gang foreman. I wrote to the supervisor at Lazar
and he never did anewer me about the ties, and then I
wrote Bailey hootton and he answered me that he would tw;e
the matter up with the railroad peOQle; end then I Saw
Jesse norgan and he told me that he would See blair and
see about the tiee.

Q. Tell the jury What kind of ties they were.

A. Qhey were Standard ties about 7 X8.

Q. What were the ties worth?

A. They had been paying me 45¢ before that, but then they
had paid me 50¢ apiece for first class ties.

Q. dell the jury whether they were culls or first class ties

A. rhey were first class, I think. I don’t heliete there
were any culls; among them.

Q. fell the jury whether you had any one looking after the
tieo for you.

‘ A. I had Joel Brett looking after them. he told me that
Lewie Hayes got two ties nd hayes paid me fariJhe ties,
and that leit 34.

Q. Did you point the ties out to :ratt?

4. he knew where they were.

Q. Did you show those ties to any one else?

A. I don't think I did.

A. No sir, they have not.

Q. Where did they come from?
A. Little Ieatherwood and pig Leetherwood, my saw mill.
Q. were they sewn ties?
A. Yes sir. ;here were some there that did not belong to
. me. I am not claiming them, and then ;eyes took two.
Q. Did you give him ehe right to take them?
A. Yes sir, I told him he could have them.
Q. What did he want with them?
A. I don't know that. i know that he said he did with
them. he said he used them in loading square timber.
Q. Did they load much square timber there?
A. Yes sir. hr. Hayee told me that was what he wanted
with them.

A. Some 100 feet from the depot down the river below the
depot. .
Q. Pretty close to the railroad?
A. Yes on the right of way.
9. Were they branded in any way?
A. I think they had my private brand on them. I had some
with the letter C and some Circle R.

A. 1 think about April, about that time.

A. They were hauled in teptember or October, 1915.

A. No sir, I did not sell to any persons ties from October
till April except Lewis Hayes and he paid me ior them.
I have sold SOUS ties to the L. c E., but did not Sell
them any here.

Q. Did you sell to any one loating lumber there?

A. Hell, I have 9010 some Since then, but did not sell ties
to any body loading lumber from that same point. rhe
lumber Was loaded below the depot that I sold to heard &
Eerdwiek.

Q. You had a suit with them ab ut the lumber?

A. Yes sir, I had to sue them before they would pay me.

Herdwick?

A. About 8000 and some feet.

Q. ind you don’t know who got these ties? -

A. I know Kr. hleir got the ties; he told me he got them.

Q. You say he told you he got them?

A. Yes Sir.

Q. You don‘t know of your own personal knowledge who got

went back they were gone.

. A. Down west about 150 yards.

' a. I know where he told me he stacked them. he told me
along in the winter that there was ties, and he wanted
me to look after them.

A. Well, I saw some men come down and IOad them on a car and
take them away.

A. Yes, I got 42.

A. Qhey were second class ties and had been used, I think
on the main line in the original construction.

a. Are you sure you did not get any of hr. Cornett‘s ties?

a. I got 4 of his ties, and went and sho.ed them to him
and told him I got them. I think it was 4 or 6 lift
ties and I reported it.

Grant Cornett in which you said you got his ties?

A. No sir, I never had any conversation with anybody in
which I said I got the ties.

Q. jhat hind of ties did you get?

A. I got some second class ties. Arch Cornett had some
ties there and there was a county road came along the
side of the railroad, and I had my man take Arch Cornett's
ties and move them across the road.

This cause care on for trial, both parties
announcing ready, the jury was impanelled and sworn. Zhe
plaintiff by his attorney then stated the case, and the
case was stated by counsel for defendant. Ehe plaintiff,
then introduced in his behalf the following witness:

Q. Your name is Arch Uornett? '
A. Yes sir.

A. Cornettsville. i
Q. fell the jury whether or not you lost any ties last
fall, and if so about when.
A. I think it was some time last October, October 191;.
d. How many?
A. I don't hnow the number myself. I had some hired hands
to haul them out for me, and they gave me the number that
they hauled, and stacked up. Then I rent over there along
this spring and passed along and saw that they had gonr
away, and I went up and asked Joel Pratt about it
said that they were taken away by d.h.nlair, all but two
and Lewis hayes took them and paid for them. where were
26 ties at first and then hayes took two and left 24, and
then the 24 were taken away by J. .. Llair for the L. a H.
people.

Q. whet position did he hold?

A. Extra gong foreman. I wrote to the supervisor at Hazara
anfi he never difi onower me about the ties, and then I
wrote Bailey Hootton and he answered me that he would toga
the matter up with the roilrooo people; and then I saw
Jesse morgan one he told me that he would See Blair ana
see about the ties.

Q. Tell the jury that kiné of ties they were.

A. Bhey were standard ties about V X8.

Q. What were the ties worth?

A. They had been paying me 45¢ before that, but then they
had paid me 50¢ apiece for first eleoe ties.

Q. fell the jury whether they were culls or first olaee ties

A. The: were first 01385, I think. I oon‘t believe there
were any culls among them.

Q. Tell the jury whether you haé any one looking after the
ties for you.

A. I haé Joel Pratt looking after them. He told me that ‘
Louie Eoyee got two ties no Hayes yaié me for the ties,
and that left 24.

Q. Did you point the ties out to Pratt?

A. Ee knew where they were.

Q. Did you ehow thoeo ties to any one else?

A. I don't think I dia.

Q. Tell the jury who e naked them.

A. George LcDoniel, Charlie Beans and Harion Holcomb.

Q. Has the railroad comgony peia you for the ties?

A. Ho sir, they have not.

A“ I think abet 50¢ apiece, about $12.00 for the Whole
lot.

Q. Is that all the ties that you had hauled out? V

A” Ho: many in all?

Q Yes, how many did you have hauled out?

A. Well, I had ties heulefi out before that, but at that
