Replying to yours of the 4th, we will
arrange to take the deposition of the plaintiff
as suggested by you.
As you are no doubt aware, Circuit Court
is now in session here and will continue in session
until the beginning of the regular term on the 14th
instant. That regular term will continue only two
weeks, and the Judge has announced that he will
not try any civil jury cases during that term.
This case will therefore not be reached for trial
until a later term and we will post pone the taking
of this deposition until after the adjournment of
the August term.
We will file an answer in this case,
pleadingramong other things the one year statute .
of limitation, in connection with the statement
