Referring to your favor of April 2nd relative to the case
of W. W. Short v. L. & 3. R. Co., BreeQEEé; Circuit Court.
The statement contained in Mr. Landrum's report on this
case was probably based on a"curb—stone" opinion expressed beams
in this office one Sunday morning in his presence. I an decidedly
of the Opinion/::athe separate coach caSes in Breathitt County we
ought to insist that section 801 of the statute applies to all
railroad employee who are on the train as such.and, with you, I
believe the courts will hold that the language of the statute is
broad enough to include section laborers traveling to and from
their work on free transportation furnished by the railroad com-
pany under their contract of employment.

Referring to copy of petition and docket report
in the above case. I am now handing you herewith Law Agent ﬂar-
ren's letter to me of Jan. 26th enclosing report of Mr. Landrum
of the same date with statements obtained by the latter covering
his investigation of the Short suit, which grows out of the Com-
pany's conductor compelling plaintiff to ride in the car in one
of the L. & E. passenger trains set apart for colored passengers,
and in which. two or three colored passengers were riding at the

Etime. My opinion is that the Company is technically guilty in
#4 this case and the probabilities are that we are going to be mulct
tin some sum. McDaniels/Eowever, has put a prohibitive price
‘on his case and there is nothing for us to do but to make the best
defense possible under the circumstances..

My information from Mr. Landrum is that on Friday
last 11 suits were filed against the Company in the Breathitt Cir-
cuit Court and about 6 of them grow out of the fact that plaintiffs
were made to ride in a "Jim Crow" car. I shall be glad if you will

; forward the investigation papers in the Short case to Mr. Hurst
£3 E at Beattyville with such instructions as you may see fit to give
5 him. You will note from Mr. Landrum's investigation that there
is nothing in the second paragraph of the petitition to the effect
that at the time of the occurrence in question plaintiff was riding
on a first class ticket. As a matter of fact all of the Company's
laborers on the train on the monning in question were riding on
free transportation in the hands of Short.
