I return herewith docket report and copy of petition
in the case or Press Napier vs. Lexington and Eastern dailway
Company filed in Perry Uounty Quarterly Court, January, 15th,
1315.
Mr. Napier has filed suit on account of the standard
Sheffield cattle guards, about which several complaints have been .
made on the extension. These guards were constructed according
to our standard and have been in good shape eVer since they was
placed in track. .
‘ From the information I could obtain it would seem that
- the fault was not with the cattle guard but with Mr. Napiers fence
between our track and the river.
hr. Clarke Campbell, Seputy Sherifi at Chavies would
make a good witness. He states that he and other witnesses heard
Mr/ Napier say sufficient in regard to leaving his fence Open so
' that stock would stray thru to his corn, It seems he thought
the damages he might secure from the railroad company
would amount to more than the actual value of the corn.
Other good witnesses in this case are Brock JiGldS, ,
Glen, Ky., Jim Eields, Section Laborer, Glen, Ky., and W~E.
Merrill, Section foreman, Typo, Ky.
