I hand you herewith some investigation in
the above styled case which I have today located in our
files and which 1 wish you would please look over in
connection with another letter which I am writing you
in regard to a settlement of this case and certain others
which are in the hands of J. M. McDaniel.

While this claim looks to be largely in the
nature of a fake, it would seem from the statements here—

gwith submitted that these cases might have to go to the

i jury, the Tom Saylers case as well as the James Saylers
5 case.

I see by docket report, dated June 24,1915,
that in the case of James Saylers by etc. the defendant
filed a Special demurrer April 7,1915, which was sustained
on April 25th,l9l5.v In the case of James Saylers v.
L&N. RR. 00. I find that on Jan. 7th,l915, defendant filed
demurrer to petition and without waiting same answer.

One of these suits is for personal injuries to

Tom Salyers and the other is for loss of services.
In the suit of Tom Saylers it has been imprOperly
brought by James Saylers as next friend of Tom Say—
lers instead of Tom Saylers by James Saylers by next
friend. I was under the impression that yauhad the ‘
{investigation file in these cases and it may be that 1
ijofi“ié}e, but I am sending herewith Mr. Landrum‘s mem—E
iorandum to Mr. Donohue of May 22nd including original E
investigation made of this case by Law Agent Shaft May-

Referring to the attached.papers relative to injury
sustained by James Saylers on June 20th to 26th, 1914, while
working for Foreman L. Larkey.

The investigation does not show a thing in our favor
and I do not want to turn it in yet. I may be able to dig up
something that will he of benefit to us. I have talked to
Larkey and he says that this boy did not work for him in June.
Before I go further into the matter I would like to know what
the time books s*ow as to the work this boy did for Larkey and
James Little. These two men had charge of extra gangs and
worked on the Athol-Maonley cut off. Will yOu please take ~
up wit}: the proper party now having charge of the time banks
f0“ the construction department and see just what work this
boy did for these two men and see who was working in the gang
in which this man was working zkxxkx from Jume 20th to June
26th.

that is, I want to show that this boy_* en aged in interstate
