Yours of the 24th relative to suit of M. C.
Napier vs. L. & E. Railway Company, Perry Circuit
Court, received.

We tried this case on the day it was set
for trial. In fact, we wound up the whole business
today. Had a hung jury. Five of the jury were for
the defendant. Mr. Hardesty was present and we had
the engineer and fireman. The plaintiff proved by
two witnesses that the train actually struck the

/ mules. However, we succeeded in hanging the jury,

“L g and I am reasonably sure that we will win this case

5 in the end.

‘ I have instructed Mr. Hardesty how to get
some additional information relative to this case,
and I think with the added information we will have
no trouble.

say that we are of tie oyinion that if the plaintiff esteb—
lishes a case ageoraing to the allegations of his getition,
and shows the feet that the mules were chased a distance of
400 yards, then it will he a QUGStiQU Li negligence to be
Submitte” to the jury. Under the Iiokett case, cited by
you in your letter above referred to, we believe this would
be true. In that case the engineer was not Charged with
knowledge; of the l cation of a culvert, but here he would

The plaintiff, h. C. Napier, says that the
defendant, Louisville 3 Nashville Railroad company, is a
corporation duly organized, created and existing under
and by virtue of the laws of the State of Kentucky, and
as such it is authorized and empowered by its charter to

, contract and to be contracted with, to sue and be sued,
and to plead and to be impleaded in its corporate name
amoresaid.

he says that the defendant, Lexington & Eastern
ha11Way Company, is a corporation created, organized and
existing under and by virtue of the laws of the State of
Kentucky, and as such is authorized and empowered by its
charter to contract and to be contracted with, to sue and
to be sued, and to plead and to be impleaded in its cor-
porate name aforeSaid, and that as such it owns, and operates,
together with its co-defendant, Louisville a Nashville Rail-
road Company, a line of railroad in and through Perry county,
Kentucky, over which it runs its freight and passenger trains
in the transportation of freight, passengers, etc.

Plaintiff states that on March lst., 1915 he was
the owner of two mules; and that the defendants, through and
by their agents, serVants and employees on the morning passenger

train on said day ran said mules from near the mouth of
Second Creek in Perry County, Kentucky, on their line of
railway, for a distance of about four hundred yards in to and
on the bridge of said defendant companies known as bridge f4,
and through the carelessness and nqaigence of Said employees
of the defendants in thus running them into said bridge the
said mules were permanently injured; that the defendants‘
train at said time was running at the rate of not more than
six miles per hour and that Same could have been easily
stopped long before it ran said mules into the bridge afore-
said, and because of the failure or the defendants, their
servants aid employees in charge of said train, to use ordi-
nary care to so stOp their train and drive said mules from
the track, and to prevent injuring said mules and as a direct
result of their carelessness and negligence in so operating
said train the said mules were injured as aforeSaid to the
plaintiff's damage in the sum of p250.00.
nnnRLrORE, the plantiff, n. C. hapier, prays judg-
ment against the defendants, Louisville & hashville hailroad
Company and Lexington a Eastern Railway Company, for the sum
of a250.00 for his costs herein expended, and for all proper
relief.
