Dear Judge:

I here your several communications of the 28th inet.,
in reference to Henry Hoore suit. I congratulate you on Winning
this case. I knew you could do it. I am particularly pleased
that there will be no urpeul prosecutea.

All of the claims mentioned in your letter will be for~
worded and voucher requested at once.

‘ Referring more particularly to your letter with ref-
erence to telegram sent you, I am afraid you got off on the wrong
feet. There was no earthly intention of questioning your compe-
tency or good judgment in the matter. Mr. McDowell Simply wanted
to be sure that the Company would not be put to any heavy expense
without reasonable assurance that a trial in the lower court would
en& the matter. Instead of questioning your discretion, by the Very
telegram I sent you, the matter was submitteu to your discretion,
for I flietinotly stuteu that we would be governed as to summoning
witnesses by .hat you might gay in reseonse. I am Sure there is

. no dieposition on the part of either of us to deprive you of any
reasonable discretion in matters of this sort, but, at the some
time, it is glain that we woulu fail in the flieoharge of our own
duties if We did not retain and exercise a like discretion. By
emaloyment, in fact, imposes upon me a supervisory control over all
Such business. While we do not disapprove your action in the
matter, we must ask that you accord to us the some treetuent and

On EV return at noon the 26th, I found your telegram and at once
requested Er. McDowell over wire to furnisa the transportation to these
witnesses. I assume this telegram was not received in time since the
transportation was not delivered to these Witnesses. However, I took
steps to get the witnesses here any now, tried tne case on yesterday
anfl secured a verdict for the defendant.

In this connection, permit me to suggest twat I Lave been prac—
ticing the quarterly court cases alone the lines sungcsted in your
telegram for over twenty years and never make so exoeotion to this

'u rule unless for reasons that appear to be sufficient to justify,
es in the case at bar. The sequel to tiis case shows tint my judg—
ment was correct.
