Dear Sir:—
Your letter or April 27th addressed to the Assistant
District Attorney sending him copy of Petition in the case of
Will Dozier seeking to recover $24.00 for dog claimed to have
been killed just south of Hazard on April 14th, 1915. I am .
just now in receipt of a leUtui from Section Foreman R.P.John=
son as follows:~
"In reply to year letter of the 25th inst.
in regard to Will Dozier's dog gettinv struck by one
of the L&N trains. I tried to find out just how dog
got hurt and could nou find out anyone who ever saw
the dog or could give any information‘whatever. I
saw the L&N Attorney and he said there was nothing
in the case. I don't think he listed the dog. At least,
Mr. Morgan said he had not listed the dog."

The plaintiff, Will Dozier, says that the 3
Lexington & Eastern Railway Company is a corporation I
created, organized and existing under and by virtue ‘
of the laws of the State of Kentucky, and in its
corpOrate name the Lexington and Eastern Railway
. Company, it has power to contract and to be contracted f
with, to sue and to be sued.
He says that the Louisville and Nashville _
Railroad Company is a corporation created, organized i
and existing under and by virtue of the laws of the
State of Kentucky and in its corporate name the Louis-
ville and Nashville Railroad Company it has power to :
contract and to be contracted with, to sue and to be
sued.
The plaintiff Will Dozier, for his cause of
action herein against the defendants, Lexington and .
Eastern Railway Company and the Louisville and Nash- - .
ville Railroad Company, says that on the 14th day of 5
April, 1915, they through their agents and employee *3
V I _ while operating a railroad train on its railroad
. . track just south of Hazard, through gross careless-
: ness and negligence ran over plaintiff's dog, black
‘ L . in color years of age and worth $24.00;

, they caused said train to run over said dog and in so
doing it cutt off his left fore leg and tail, thereby
permanently injuring and destroying the usefulness of
his said dog and property. He says that by reason of
the above and foregoing negligence acts of these de-
fendants he has been damaged in the sum of $24.00, which
he believes he ought to recover of these defendants ‘
therefor.
' Wherefore, the plaintiff Will Dozier, prays
judgment against the defendant, L. & E. Ry. Company
’ . and'the L. & N. R. B. Company for the sum of $24.00
and all proper relief. 1
