I have not had occasion, for some time, to consider the
question as to what constitutes swearing as between the
servant of a carrier and a passenger. I did have occasion
about a year ago to write a brief in a Master and Servant
case, in which the question was presented, towit; Jesse Simp—
son v. L&N R. Co. I am mailing you under separate cover
today a copy of my brief in that case. The Court of
Appeals reversed the judgment several days ago, and held
that defendant was entitled to a peremptory instruction.

I am mailing the opinion in that case to messrs. Shelby,
Northcutt & Shelby today, and have requested them to let
//, you read the opinion before they return it to me.
You might see wears Ry. Co. v. Strosnider, 121 SW ‘
1; 971, which I differentiate in the Simpson case, but which
‘fii may be applicable to your case. I Will try to investigate
\ the question further and write you again.

If the case is a bald case, as the Simpson case was,
I think there might be a chance of the Court of Appeals'
granting the appeal and reversing the judgment, as they
did in the Simpson case.

the proposition that a statement by a witness while testi—
fying, "It is none of your damn business," did not constitute
swearing and cursing in a public place. I have not had
time to examine the case.
