The above—styled case is set for trial at Jack—
son on the sixteenth day of the term, or, Thursday of the
third week.

\\g I now hand you Law Agent Landrum's letter to me,

§;§ of July 14, in which he recommends a settlement of this

:3: case, at not exceeding #75, if necessary to go that high ‘

5> in order to secure a settlement, but thinks possibly the

%\ On July 10 I wrote Mr. Landrum as follows:

‘v "The only investigation we have, in this case,

E: consists of a letter from Superintendent Seargeant to
hr. Donohue, of date June 19, 1916, a copy of which
:f was sent to Judge Wilson, as fellows:

\J "'Your letter of June 15th, referring to Judge
Wilson's of the 14th, suit Curry Patrick seeking to
recover $2000.00 failure to deliver a telegram for—
warded to him at Stanton by Sherman Morris from Jack—
son, April 5rd, 1916.

"'There is attached hereto 3 copy of the wire

in question. You will note that it bears an OK at
12.11 p.m. Mr. Shennan Morris is in the employ of
this company working as clerk at Jackson. Thezgent
says that in conversation with Morris he reports that
the message was filed with Operator w. R. Robinson,
who is not now in the service but is working for the D.
T. a I. at Detriot, and offered to pay for its trans-
mission but Robinson informing Morris in view of the
fact that he was an anployee he would send it Dead head.
Morris then informing Robinson that he did not care how
it went just so the infonnation was given to Patrick.
Further informing Robinson to advise the Agent at Stan—
ton that the message could be deliVered to Patrick by
his children who were attending school at Stanton.

"'The Agent Stanton says that his information from
Robinson at Jackson was that Patrick lived somewhere between
Stanton and Rossyln and inquiry from any number of children
passing the station that day failed to indicate that there
was any such party as addressed.

"'The Agent Stanton says also that he could not leave
the office and not knowing where Mr. Patrick lived made no
effort to deliver it.’

"Please undertake at once to make whatever investiga—
tion is necessary to verify the claim of Curry Patrick,
that he did not know of the death of his son, and could
not have got to Lee dity, in time to attend the funeral.

"I will try to have Operator W. R. Robinson, re—

~ ferred to in Superintendent Seargeant's letter of June
19, interviewed in regard to this case. '

"I wish you would particularly investigate this case
at Stanton, as it seems to me that, if Patrick was living
right near Stanton, our agent should have had no difficulty
in making delivery. I feel somewhat apprehensive about
this case.

"In the case of Western Union Tel. Co. v. Snodgrass,
the Supreme Court of Texas held as follows:

"’In an action against a telegraph company fbr dam~
ages for failure promptly to deliver a message sent plain—
tiff by one acting as his agent, the fact that the message
was transmitted without charge, because of the sender be—
ing an employee of the defendant, was no defense.‘

"If this is the law in mentucky——and I have very lit—
tle doubt that it will be held to be, in a proper case, as
the Snodgrass case is cited as authority fer this state—
ment of the law feund in 37 Cyc., page 1664: 'A telegraph
company may require, before accepting and contracting to
transmit a message, that its reasonable charges for the

service demanded shall be prepaid; but the right to
require such prepayment is a privilege which the com—
pany may waive, and it it undertakes to render a dead~
head or collect service service, or to extend credit
therefor, charging the tolls for the same at the regular
tariff rates to the account of the sender, or agreeing
to accept payment at a later date, it is held in the ab—
sence of contract to the sane degree of care and dili—
gence as though the charges had been fully prepaid,'——I
am afraid we are going to find that this case is going
to be one for settlement if your investigation at Stanton
shows that we did not use reasonable diligence to make
delivery of this message.

"Please hurry this matter all you can, and let me

know the least amount for which this case can he settled."

I have not yet been able to secure any information
from W. H. Robinson, who is now in the employ of the Detroit,
Toledo & Ironton R. Go. I doubt if I shall be able to do so
by the time this case is called for trial; but it would seem,
from Mr. Landrum's letter to me, of the 14th instant, that,
when seen, his evidence can not help us very much.

Please wire me promptly, upon receipt of this letter,
what you think about our liability in this case and the advisa-
bility of settling at not exceeding $75.
