we have been unable to reach an agreement with plaintiff's at-
torney for the reason that he has demanded $100 in settlement

Dear Sir:
On the 12th inst.,ono Irvine Turner,who is
a teacher in the Jackson Graded dchool,left here for Lexington,
and after boarding the passenger train at Jackson and at the
time the train was moving out,Turner was standing on the platform
_ and did not have time to enter the rear car. hr. Boocook,the
conductor passed from the smoker in to the rear car and slammed
the door together mashing hr. Turners hand,cutting the little
finger of the right hand more than half in off. Mr Dunrner ask
me to take this matter up with the Company at once and I conclud-
ed to write you about it.
I want just $250 for that finger and will give
. the Company just ten days in which to settle the matter and if
it is not done by that time then I will file suit on the claim
and the finger will cost you just three times that amount,or at
least that is my calculation. I wish you would advise me as soon
as possible about this matter as I feel that we could settle I
. without going into Court about it. I was present on the car at
the time this accident happened and I know personally that Mr.
Turner was not in fault.

"In reply to yours of May, 19th, concerning the injury to
Irvine Turner. I have consulted my crew they don't know anything about
this injury. I was on No. 4 May, 12th. I always get on the head end of
smoker leaving Jackson and it is very seldom that I can make it to the
first class car before I get to 0&K Junction. I always make a report
of all personal injuries that I know of. Mr. Turner said nothing to me
at all about being hurt, furthermore, I do not make a practice of
slamming doors and often call my flagmans attention to same. my flagman
always gets on train at Jackson between lst, and 2nd, class cars. He says
nothing of this kind happended to his knowledge".

My name is E. c. Carpenter. I live at Lexington, Ky. I was
flagman on train No. 4 Mny 18th. 1916, with Conductor Booook. I know
nothing whatever about accident to this man. No one said anything to
me concerning the matter at tnr time and the first inferma ion I had ‘
concerning the matter was when the Conductor received kiter about it-
Leaving Jackson on train NO. 4 I sometimes catch the rear end ei‘tne
train and sometimes get on at the front end of thc Lady's oer. I do not
remember where I got on on this trip. I do not remember seeing this man
on the train with his finger mashed. .

My name is F. A. Bocook. I live at Lexington, K“. I waa Cond'r
on train No. 4 May 13th, 1916. I know nothingcwhatever about Irvine
Turner getting his finger mashed at Jackson on that data. I Am
sure that i did not close the door on his finger as leaving Jackson I
:31: get on the train at the dront end of the colored car and do not
gointo the lady's car until xfxxrx after working the colored car and
the smoking car. No one said anything to me about this matter at
the time and the first infonnation I had about it was letter I
recioved making inquiry.

apparent that if we went into a law suit over this matter we would
have to do so without anv reliable evidence as to how the accident
happened since the crew which is supposed to have knowledge of the
acciTent sav that know nothing about any such ocoUrrence.
