Referring to copy of petition and docket report
in the above case which grows out of the fatal injury to Jay
Childers, laborer, near COpland, Ky., May l7th,l915, while he was
employed in a work train. I an handing you herewith that part of
our file 74157 which contains the investigation papers covering
the Childers accident. This accident resulted in litigation be-
cause we were unwilling to pay Hardin Childers, the father of the
boy $550C} he would not accept less.
7 mhe petition alleges that Childers was thrown .

I from the car upon which he was riding by an unusual, unnecessary
‘Eggwxiolent jerh of the train and I very nueh tear, inasmuch as
some of the men who were working on the same train at the time
of the accident, notably Brakeman D. Banks, are not now in the '
service, that some evidencewwillwhewgohnd to support the allega-
tion of the petition notwithstanding the fact that when witnesses
were interviewed by Law Agent Warren all of them stated positively

' A reading of the petition will Show that plaintiff is 57W
seeking to recove: not only on account of decedent's alleged wrong— 1
ful death but on account of physical pain and suffering endured A
before death ensued. Notwithstanding Mr. Laugherty‘s work on the
Federal Employers‘ Liability Act to which hr. Warren refers, I am \
; very SHTO that this cannot be done. dead Section 9 of the act and
St. L. l. M. & 3. By. 00. v. Hesterly's Admr. 228 U. S. 702. As
I read the actJSection 9 provides in so many words that these can: 5‘”
be.ns recovery for both. It seems to me we eight to file a motion
requiring plaintiff to elect which cause of action he will proceed I
under and have the court pass on said motion without argument if 7
this can WP done.
I do not know just how familiar Mr. Gourley is with the
cases construing the federal act but I suggest for the considera—
tion of yourself and Judge Pollard the taking of Hardin Childers'
deposition under sub«section 8 of section 606 of the code for the
purpose of learning to what extent, if at all, Childers and his wife

that Gourley is fully alive to the importance of showing a depen—
dency of ‘_he kind mentioned and the pw‘ition he has drawn in this .
case clearly indice’fies that he is but the taking of the deposition
as suggested cannot do any harm.

I Dear Sir,

Referring again to your favor of June 26th, relative to the
Childers suits now pending in the Breathitt Circuit Court.

There is certainly no reason why your plea in abatement should
not prevail and I believe that it will,notwithstanding Mr. Gourley.

‘ But, as a practical propositiOn, are we likely to be hurt to any
material extent, even though the trial court does not hold with
you? Certainly the plaintiff will not be permitted to collect
a two Judgments and I think we are going to find that it is the tir§t_
a and not the second suit upon which Mr. Gourley will rely when it comes
% to a show down.

You will recall that by his petition inflthemgi§§t_§uit plaintiff
seeks to recover not only for the alleged wrongful death of Hardinl
Childers, but for the pain and suffering endured by him as a conse—
quence of his accident. The question involved is not entirely free

My dear Warfield: -

Rivinus and I have been for some time endeavcring to formulate
some theory of death actions based upOn the Federal Employers' Liability
Act such as will be logical and reasonable. We have had in mind partic—
ularly the difficulties induced by the 9th Section which was injected in-
to the Act by the anemdment of 1910. You are so familiar with the cases
that I need not cite them and you know that in construinc the Act before
the amendment the measure of damages in death actions was limitec to the
pecuniary damage from the view-point of the particular beneficiaries in
each case- But the amendment of 1910, in providing that the action
"shall survive" has, in one view at least, introduced questions of meas—

' ure of damag=s with which the enclosed paper attempts to deal. As oppos-
ed to the vinw that the measure of damages in the 9th Section is not the
pecuniary damage to the beneficiary it may be urged with same force that
the same words are used in that Section as in Section 1 to describe and
designate the persons entitled, Amoug other terms used is the term "next
of kin dependent upnn such employee", which may afford ground for the
argument that this hybrid or obscxre action created by the 9th Section is
limited to the pecuniary damage to the beneficiaries in each particular
case. You will see frOm the memorandum, and in fact it would occur to
you Without the memoraidum, that there are other serious practical diffi-
culties in the way of this last mentiOned constructiOn, however desirable
it may bP- One such difficulty is that the value of the life, judged by

..'earning power, and so forth, to the beneficiaries has a direct relatiOn
to the injury to those beneficiarh=s= whereas, the cause of action which
the injured man had in his lifetime includes elements like pain and suf-
fering which have no relation whatever to the damage his beneficiaries
may suffer if he die from his injury or some other cause- The action
granted in the 9th SectiOn seems to have no necessary relation whatever
to pecuniary damage to benefi.ciaries: and, if we are to bring about the
desired result of c0nfininy actions under this SectiOn to pecuniary dame
age to the beneficiaries this must be none, I should think, by urging the
a'gument that Congress has shown an intention so to confine this remedy
to pecuniary damages by designating the beneficiaries, includin; next of
kin dependent upon such employee as under the lst Section.
