Howard Eakle Plaintiff
vs. Petition.
Louisville and Nashville Railroad Company Defendant.

Ommes now the plaintiff, Howard Eakle, and for his cause
of action herein, says that the defendant, Louisville & Nashville
Railroad Company is a corporation, created and existing under and
by the laws of the state of Kentucky, with power under its char-

’ ter to sue and be sued, and to contract and contract with and to
own and Operate a railroad and that on the date hereinafter men-
tioned it was the owner of and operated a railroad which passess
through Perry County, Kentucky.

. He states that on or about the _____ day of December,
1917, a cow owned by the plaintiff, of the balue of $100.00 -
strayed on the track of the defendant, in the said county and
the defendants by its agents, employees and servants, so care-
lessly and negligently managed its engines and cars that the
same ran over and killed the cow, that the said cow was a red
muley about eight years old, good milker giving about two gal-

, lens of milk per day, that cow had a young calf and had been
fresh only about one month; that said cow was killed at or near

V Slab Town north of Viper, Kentucky, he says that by reason of
the foregoing facts he has been damaged in the sum of $100.00.

Wherefore the plaintiff prays judgment against the
defendant for the sum of $100.00 in damages, for his cost herein
expended and all prOper relief.
